This section requires a single point of access for each lot "from only one street, shared driveway or alley established at the same time as the subdivision." Section 14-404(B) provides that a lot may have reasonable access from a public street abutting the subdivision if four conditions are met: i) The agent approves a variation or exception under Section 14-404(D) and Section 14-203.1. In accordance with paragraph 1 of subsection D, a conceptual plan is provided for consideration. Sheet C5 of 5, titled "Preliminary Plan of Development" is provided with the Preliminary Subdivision Plat Application, dated May 21, 2018 and last revised on August 22, 2018. The conceptual plan proposes 2 (two) shared driveways accessed from Rio Road (State Route 631). The first driveway will replace the existing entrance and will be shared by the existing duplex and a new single-family detached dwelling. The second driveway will provide access to two new single-family detached dwellings. The two new entrances will replace an existing 120' entrance which serves an 8,100 square foot parking area, to be removed. The current parcel, TM -P 61-191, is 2.14 acres and contains a stream buffer, floodplain, and preserved slopes and 654 feet of frontage on Rio Road. The conceptual plan (Sheet C5) will effectively reduce the impervious area of the site by 1,500 square feet; increase the residential density by 150% (on a site designated for neighborhood density); provide a prescriptive easement for Rio Road; and bring the existing development into conformance with current environmental regulations. ii) The subdivider obtains an entrance permit from the Virginia Department of Transportation for the access. The Preliminary Subdivision Plat Application is submitted for review by the Virginia Department of Transportation. iii) The entrance complies with the design standards set forth in sections 14-410(1=) and 14-410(G). In this request, subsection F is not relevant because this proposal does not require the approval of any streets (public or private). The request is for a second point of access, to provide a shared driveway, from an existing public street. Compliance with subsection G is anticipated with the review of a final plat application. iv) The subdivider demonstrates to the agent prior to approval of the final plat that the variation or exception does not violate any covenants to be recorded for the subdivision. This requirement will be demonstrated prior to approval of the final subdivision plat application. Thank you for your consideration of this request.
