Statement of Basis
I understand that any surface water or wetland impacts associated with this project, including any
subsequent modifications or additions thereto, may require specific authorization from DEQ under the
Virginia Water Protection Permit Program before any such impacts are taken. I also understand that
impacting surface waters including wetlands without a permit, when such a permit is required, may
subject the project proponent to enforcement action for violations of State Law and/or Regulation. As
such, I have used due diligence in assessing the presence of surface waters, including wetlands, on the
project site to ensure that no unauthorized impacts are associated with the proposed project.
This assessment included the following (please check all that apply):
0 USACE Confirmed Jurisdictional Determination
Q On-site evaluation by a qualified wetland professional
NRCS Soil Maps
0 National Wetland Inventory Maps
USGS Topographic Maps
0 Other (please specify) NWI Map shows R4SBC (Riverine, intermittent, streambed, seasonally flooded).
Based on this review, I hereby certify that:

0✓ Surface waters or wetlands exist on the property but no impacts to those regulated areas will
occur as a result of this project.
0 Surface waters or wetlands will be impacted but those impacts are exempted from permit
requirements per 9 VAC 25-210-60. Please cite specific exemption:
No impact; this natural -method stream restoration project is anticipated to enhance aquatic /wetland values.
Surface waters or wetlands will be impacted and have been permitted by the DEQ and/or the
AUSACE. Copies of these permits are attached.

Dear County of Albemarle:
As the owners (the "Owners") of Albemarle County Parcel ID 061ZO-01-00-00400 (the
"Property"), we hereby grant permission to the County of Albemarle, its employees, agents,
contractors, and assigns (collectively, the "County") to enter upon the Property to enable the
installation of stream restoration improvements by the County.
We hereby make this Property available to the County as is. Further, the County, its
employees, agents and contractors enter the Owners' Property at their own risk for the term of the
installation. This Right -of -Entry shall expire upon completion of installation.

Enclosed is a copy of the U.S. Army Corps of Engineers' Jurisdictional Determination (JD)
(NAO-2017-02165) confirming the wetland delineation prepared by Wetland Studies and Solutions, Inc.
This JD is valid for a period of five years from the date that it was issued (December 27, 2017).
Please note that this JD is only the U.S. Army Corps of Engineers verification of the wetland
delineation and does not constitute authorization to impact any waters of the U.S. on the site. If you have
