Address the following: g) Provide all existing or proposed HOA documents, supplemental document, deeds and/or separate maintenance documents showing both the ownership and maintenance of all private street easements that are being expanded with this plat. Rev. 1: Comment not addressed. Provide all existing or proposed HOA documents, supplemental document, deeds and/or separate maintenance documents showing both the ownership and maintenance of all existing and proposed access easements and alleys. Rev. 2: Comment not fully addressed. See comments below. Rev. 3: Comment not fully addressed. See comments below. [14-302 (A)(4) & (14)] Private Easements; Land to be dedicated in fee or reserved. Address the following: g) Provide all existing or proposed HOA documents, supplemental document, deeds and/or separate maintenance agreements showing both the ownership and maintenance of the alleys, private streets and landscaping easements and additional access easements for sidewalks. These documents will be reviewed by the County Attorney. Address the following: a. With existing documents they must be worded to automatically incorporate new or expanded easement areas, and expanded private streets, or a new supplemental document must be provided that adds the new areas/easements. Rev. 1: Comment not yet addressed. Address this comment. Rev. 2: Comment not fully addressed. Address the following: I. In section 3 of the supplemental declaration the easement plat has the wrong initial submission date of October 15, 2017. This instead should be October 16, 2017. Rev. 3: Comment Addressed II. No mention of the expanded width of Grand Forks Blvd. and Laurel Park Lane (Sheet V2) appears to be included in the supplemental declaration. Either revise the document to integrate the expansion of the private access easements or discuss this with the plan reviewer. Rev. 3: Comment not fully addressed. See the attached revised word document showing the County Attorney's revisions and comments. Please note that the "New Area of Private Access Easement" that is in the comment balloon is the area of the expanded roads that have not vet been integrated into the "Roads". No mention of the "New Area of Private Access Easement to be Extended" is included in the supplemental declaration. These expanded areas of the roads must be owned and maintained by the HOA. d. The plat will not be approved until these documents have all been approved, signed, notarized, and a copy of the notarized documents provided to the plan reviewer. Rev. 1: Comment not yet addressed. Address this comment. Rev. 2: Comment not fully addressed. Address this comment, once all revisions to legal documents specified in these comments have been fully addressed. Rev. 3: Comment not fully addressed. With this next submission submit signed and notarized COPIES of all of the documents that have be part of this review. Please note that a signed (by County) original of the stormwater easement deed will be left at the front desk for you to pick up. This must be signed and notarized by the owners and then a COPY of it submitted back to the planner with the rest of the documents. e. Any new documents that provide ownership and/or maintenance of the easements/private streets must be recorded at the same time as the easement plat. Rev. 1: Comment not yet addressed. Address this comment. Rev. 2: Comment not fully addressed. Address this comment, once all revisions to legal documents specified in these comments have been fully addressed. Rev. 3: Comment not fully addressed. See comment for (d) above. f. Ensure that the final version of all documents reference this plat with the correct name, date and revision date at the time of recordation. Rev. 1: Comment not yet addressed. Address this comment. Rev. 2: Comment not fully addressed. Address the following: I. A portion of the supplementary declaration (Section 1) references a subdivision plat that will not have been approved at the time of recordation of this plat and declaration. The subdivision plat may require modification after the approval of this easement plat, and therefore the date may not be correct. Revise the supplemental declaration to address this. 11. A portion of the supplementary declaration (Section 1) is referencing the subdivision of the lots and creation of open space which will not take place until after the recordation of the easement plat and the supplemental declaration. Revise the supplemental declaration to address this. The subdivision of lots and creation of open space should be accomplished with a different declaration once the subdivision plat has been approved. Ill. A portion of the supplementary declaration (Section 1), when specifying in which plat the alleys are shown and created, references the a "subdivision plat" that will not exist at the time of recordation instead of the "easement plat" which is creating them. Revise the supplemental declaration to address this. Rev. 3: Comment Addressed [14-302 (A)(15)] Identification of all owners and certain interest holders. Provide all existing or proposed HOA documents, supplemental document, deeds and/or separate maintenance documents showing both the ownership and maintenance of all private street, alley, access easement and landscape easement that are being created or expanded with this plat. Rev. 1: Comment not yet addressed. Address this comment. Rev. 2: Comment not fully addressed. See comments above on revisions required to the supplemental declaration. Rev. 3: Comment not fully addressed. See comments above on revisions required to the supplemental declaration. 14. [NEW COMMENTI See the attached comments from other reviewers. Please note that no legal documents have been provided in reference to these proposed easements or the maintenance agreements associated with the easements. These documents once submitted must be reviewed and approved by the County Attorney's office. See comment #3 above. Rev. 2: Comment not fully addressed. All legal documents were submitted as of 6/21/18 and have been reviewed. See the required revisions to the supplemental declaration outlined in the comments above. Rev. 3: Comment not fully addressed. See the required revisions to the supplemental declaration in the attached document from the County Attorneys office and outlined in the comments above and below. 15. [REV. 3: NEW COMMENTI See the attached Word document file with the required changes and comments from the County Attorney's office. In addition to the items mentioned above the County Attorney found one other item missing from the Supplemental Declaration. In the comment balloon they specify that there are "New 7' Private Access & Maintenance Easement" that are not yet included in the supplemental declaration and need to be.
