Perez, Senior Planner Division: Planning Date: September 28, 2018 Subject: SDP201800036 Oak Hill Convenience Store — Special Exception Request Fax 434-972-4126 Each review comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified. 1. [21.7(C)] Buffer Zone Adjacent to Residential Districts (Area A). Directly behind the shared property line w/ TMP 76- 52P is a stand of large mature evergreen trees which runs for the duration of the proposed development. The root systems of these trees are located within the 20 foot buffer on the commercial property. It is staff s concern that disturbance of this area would damage the root systems of these trees, causing the damage and loss of the existing evergreen screening on the adjacent property. It is estimated that the roots of these trees traverse a minimum of 15 feet into the buffer. It is staff s position that no grading take place within 15 feet of the property line. Additionally, to provide the required screening on the commercial property staff requests a 6' tall wooden fence be built on the 15 foot line, with a single row of evergreen trees in front of the fence facing the gas station. Please revise the exhibit to depict the above request. Staff will recommend approval of the SE with these revisions. Is this amenable to you? 2.
