Subject: SUB201800148 Charles and Betty McDonald, TMP 43-90, 91 - Boundary Line Adjustment
The County of Albemarle Planning Division will recommend approval of the plat referred to above when the following
items have been satisfactorily addressed. (The following comments are those that have been identified at this time.
Additional comments or conditions may be added or eliminated based on further review.)
This review was completed using the sections listed under Section 14-208.1 of the Subdivision Ordinance.
Planning
1. [Section 14-302(A)(10)] Division Rights. Please indicate the current number of Development (Division) Rights
assigned to each lot; TMP 43-90 and TMP 43-91. The plat should contain the statement(s), "Parcel [letter or
number] is assigned/retaining [number] development rights and may/may not be further divided and when further
divided, these rights shall not comprise more than [number] acres ".
2. [Section 14-302(A)(16)] Dam Break Inundation Zones. The County GIS system indicates the existence of a Dam
Break Inundation Zone, which runs through TMP 43-90 and possibly clips TMP 43-91 on the northern end.
Please verify and update plat accordingly to indicate any Dam Break Inundation Zone.
3. [Section 14-302(B)(7)] Reservoir watershed. The plat incorrectly states that the property is not located in a water
supply watershed when, in fact, it lies within the Lower Mechums River Water Supply Watershed. Please update
this comment.
4. [Section 14-302(B)(9)] Flood Plain. The plat indicates a "100 Year Flood" line in the northern section of TMP
43-90, however, another section of the same line in TMP 43-91 is labelled as "100' Stream Buffer". The County
GIS system contains two polygon layers indicating both the WPO Buffer (100' Stream Buffer), and a Flood
Hazard Overlay ("I 00 -year Floodplain"), which are distinct with different boundaries. Please revise the plat to
accurately illustrate these two outer boundaries in relation to the identified stream or provide a statement
explaining how your boundaries were arrived at.
Remove existing note regarding the 100 Year Flood Zone, which states the `property does not lie in a FEMA
defined 100 year flood zone... " and add a note to the plat to indicate that TMP 43-90 lies within the Flood Hazard
Overlay Zone.
5. [Section 14-302(B)(10)] Stream Buffers. See Comment 3 above. Additionally, the following statement should be
added on the plat: "The stream buffer(s) shown hereon shall be managed in accordance with the Albemarle
County Water Protection Ordinance. "
6. [Section 14-303(L)] Public utility, drainage and sight distance easements. A drainage is easement is indicated on
the plat, running north -south from the stream through TMP 43-90 down to Wind River Road. Please clarify if this
is a new or existing easement and indicate the width.
7. [Section 14-303(0)] Signature Panels. Please revise the TMP numbers in the Owner's Approval statement to
reflect the correct parcels. They currently read "TMP 114-57A3 & 57A4".
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and may
be found at www.albemarle.ora/coq4tycode.
In accord with the provisions of Section 14-229(B) of Chapter 14, if the subdivider fails to submit a revised plat to address
all of the requirements within six (6) months after the date of this letter, then the application shall be deemed voluntarily
withdrawn.
