The permitted uses of the Property are provided in Section 16 of Chapter 18 of the Albemarle County Code ("Zoning Ordinance"). The property is located in the Entrance Corridor Overlay District (EC) and Airport Impact Area (AIA), and the Steep Slopes Overlay Districts as described in Section 30 of the Zoning Ordinance. An assisted living facility, or skilled nursing facility is allowed in the R-6 zoning district by Special Use Permit. SP1985-004 was approved with conditions on March 20, 1985 to allow a 120-bed nursing home facility, this use is the same as what is now identified in the Zoning Ordinance as an assisted living facility, or skilled nursing facility. A copy of the approval letter with conditions is linked. The Property is in compliance with zoning district regulations. • According to the County's property records, the building was constructed in 1987. The site was developed under SDP1986-00028 which was approved for 120 beds served by 116 spaces. A minor amendment, SDP1995-00056, was approved for a dining hall addition. The Property was built in accordance with the approved site plans. • The off -site sign is subject to a Special Use Permit, SP2009-00005, which was heard and granted by the Board of Zoning Appeals on April 7, 2009. The Property is in compliance with the sign ordinance. • In the event of damage or destruction, the facility can be rebuilt on the Property as it currently exists. • Any change of use which require site or building modification or additions are required to comply with the applicable zoning, subdivision, building and water protection laws in the future.
