Thank you for more fully explaining the provision.
In accordance with the provisions of Chapter 18, Section 33.52(C) of the Albemarle County Code, and on behalf of
Regents School, I hereby request that Board of Supervisors action on SP201800011 be deferred until June 1, 2020.
Although we do not anticipate needing this amount of time, we are requesting this more lengthy timeframe at the
suggestion of staff. Please confirm this email is sufficient to satisfy the new code provisions.

SP201800011. With this, you can now submit a written request for deferral (as outlined in the notice and in accord with
the recently -adopted Zoning Ordinance Section 33.52).

Hello Ashley,
Thank you for this message. I confirm receipt of this request for a deferral for SP201800011 which was received on
7/16/2018 and which has submittal date of on 7/31/2018.
As you may know, Section 33 of the Zoning Ordinance was recently amended, and the procedures for deferrals have
been modified as follows:
Sec. 33.52 Deferring action. After submitting an application but before action by the Board of
Supervisors, an applicant for a zoning map amendment, special use permit, or special exception may
request a deferral as follows:
C. Request for deferral on applications submitted less than 36 months before September S, 2018. For
any application submitted less than 36 months before September 5, 2018, the applicant shall submit a
written request to defer to the Director within 30 days after the applicant receives written notice
from the Director about the requirements of this subsection. The Board shall act on the application
within the 36-month period or a reasonable period of time beyond the 36-month period required to
complete the review of the application and to hold any required public hearings,
33.54.B. When an application is deemed withdrawn. An application shall be deemed to be voluntarily
withdrawn if the applicant requests deferral pursuant to subsection 33.52(A) and fails to provide
within 90 days before the end of the deferral period all of the information required to allow the Board
to act on the application, or fails to request a deferral as provided in subsection 33.52(B) or (C).
The language about submitting a request for deferral "...after the applicant receives written notice from the Director
about the requirements of this subsection" apparently includes the need for you to identify a specific date for the
deferral to end. I've asked for some assistance from Megan, Bill, and Andrew on this, since this is a new procedure,
and since you (applicant for SP20180011) have not received this "written notice."
One of us will follow up with you soon, regarding the "written notice" and regarding details of all next steps for
requesting a deferral under this new procedure.

Please accept this as our request for a deferral of the Regents School SP request. We are diligently working on the traffic
study information that has been requested, but I don't think we will have all of our submittal documents prepared in
time for the County deadline.
