RE: LOR #1 to SDP201400054 - Glenmore Storage Tank Pump Station
Dear Sir:
Department of Community Development has reviewed the above referenced proposal against applicable codes and
ordinances. Comments are provided below:
1. [Special Exception - Conditions of Approval from SDP2014-54] It appears that the existing trees which
were required to be preserved within the 20' ACSA landscape easement (DB 4593 PG 303) located on TMP
093A1-00-00-00400 have been cleared and graded. The only trees that remain in this vicinity are located on the
Fire Station property in the same location as the ground storage tank is to be located. Please verify.
Staff came to this conclusion after a recent site visit, in which measurement tape was utilized to measure from the
existing edge of pavement on the fire station parking lot through the remaining tree stand. The remaining trees
appear to be located entirely on the Fire Station property, in the same location as the ground storage tank is to be
located.
Based on the above circumstances condition #1(b) from the Special Exception approval (attached) shall be
enacted. Please work with Rivanna Village, Alan Franklin — Engineer, to rectify the issue. Please submit a
landscape plan for the 20' landscape easement that complies with Albemarle County code Section 32.7.9 and
section 32.7.9.7. Screening is the focus of the above requirement. Rev 1. Comment addressed.
2) IWPO2014-771 15' Conc. Storm Drain. On TMP 093A1-00-00-00400, within the 20' landscape easement, a
"15" Conc. Storm Drain" is proposed/depicted. Such an improvement including the grading should not have
been permitted in this area. Please work with Rivanna Village, Alan Franklin — Engineer, to rectify the issue. If
the required plantings can be planted atop the 15" conc storm drain, this does not appear to be a problem.
However, if this is the case, please provide written documentation from the property owner that this is permitted.
If the required plantings cannot be planted atop the 15' conc storm drain, then a revised WPO plan relocating the
drainpipe out of the 20' landscape easement shall be submitted. County landscape standards for screening
purposes shall be adhered to within the 20' landscape easement. There will be no reduction in size and
standards of plantings below the minimum required planting requirements within this area.
Explanation of how this error may have occurred: WP02014-77 was submitted on 9-2-2014 and approved on 6-
16-2015; however, it did not depict the 20' landscape easement. The Special Exception requiring the 20'
landscape easement was approved on 12-3-2014. The plat (SUB2014-188) recording the easement was submitted
on 11-17-2014 and approved 3-12-2015. Thus the WPO plan should have been revised by the applicant to
include the 20' easement (DB 4593 PG 303). Rev 1. Comment not adequately addressed. It is suggested you
relocate the proposed plantings depicted on the plan closer to the boundaries of the 20' landscape
easement to provide more distance between the plantings and the drainpipe. Additionally, County
Engineering has also provided a comment on this aspect of the plan, as follows: "County policy is generally
to not allow large trees within a drainage pipe easement. If verification is provided from an arborist and from
Rivanna Village (Alan Franklin) that the plantings will not adversely affect the pipe, the plantings can
remain as shown. Otherwise the trees will need to be outside of the drainage easement. "
3) [32.7.9.7(d)] Minimum depth and spacing requirements for a planting strip. Currently the proposed planting
strip fronting Steamer Drive is only 10' wide and merely provides a single row of plantings. The ordinance
requires 20' planting strip and double staggered row of plantings. In order to move forward as proposed, at a
minimum please provide a 6' tall wooden fence behind the plantings on the side closest to the tank.
Rev 1. Comment addressed with revised plantings.
4) [32.7.9.7(e)] Minimum height offence. On the plan label the height of the site fencing. Label the type of
fencing ("black metal security fence"). Note: This type of fencing does not provide screening, thus comment #3
remains valid. Rev 1. Comment addressed.
5) [32.7.9] Landscaping. Identify which plantings are American Holly and which are Thuja Green Giant.
Rev 1. Comment partially addressed. The County's approved plant list references the common name of
"Thuja Occidentialis" as "Eastern Arborvitae"; rather, than "Green Giant". Either revise the common
name to be "Eastern Arborvitae" or revise the botanical name to match that of the "Green Giant", which
is "Thuja Plicata". Both plant types are appropriate for screening purposes.
6) [Special Exception - Conditions of Approval from SDP2014-541 The rear setback for the facility is 20' per
the approved special exception; however, on this LOR the facility appears to encroach within the 20' setback. In
order to verify depict and label the rear setback on the plans as it related to TMP 093A1-00-00-00400. Rev 1.
Comment addressed.
Engineering Comments — Matthew Wentland
1. County policy is generally to not allow large trees within a drainage pipe easement. If verification is provided
from an Arborist and from Rivanna Village (Alan Franklin) that the plantings will not adversely affect the pipe, the
plantings can remain as shown. Otherwise, the trees will need to be outside of the drainage easement.

RESOLUTION
WHEREAS, the County of Albemarle (the "County") and the East Rivanna Volunteer Fire
Company, Inc. ("ERVFC) are the owners of Tax Map and Parcel Number 093A1-00-00-00200 (the
"Property"); and
WHEREAS, the Albemarle County Service Authority ("ACSA") filed a request for a special
exception in conjunction with SDP 2014-00054, Glenmore Ground Storage Water Tank, Pump
Station and Water Mains, to allow a 35 -foot tall water tank to encroach the 35 -foot structure
setback along the side and rear lot lines as depicted on the pending site plan for the property under
review by the County's Department of Community Development.
NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the foregoing, the
executive summary prepared in conjunction with the application, and its supporting analysis
included as Attachment C thereto, and all of the factors relevant to the special exception in
Albemarle County Code § 18-4.10.3.1, the Albemarle County Board of Supervisors hereby
approves the special exception to reduce the side setback from 35 feet to 32 feet and to reduce the
rear setback from 35 feet to 20 feet along the respective property lines abutting Tax Map and
Parcel Number 093A1-00-00-00400, subject to the conditions attached hereto.

SDP 2014-00054 Glenmore Ground Storate Water Tank,
Pump Station, and Water Mains Special Exception Condition
The Albemarle County Service Authority (the "Authority") shall obtain a landscaping
easement (the "Landscaping Easement") on Tax Map and Parcel Number 093A1-00-00-
00400 in the location shown for the "Prop. 20' Landscaping Easement" on the Site Plan —
Grading Plan and Landscaping Plan (the "Plan"), last revised November 4, 2014, attached
hereto, subject to the following:
A. Any tree shown on the Plan whose trunk is located within the Landscaping
Easement shall be preserved and maintained by the Authority;
B. If any tree within the Landscaping Easement dies, is removed, or is otherwise cut so
as to no longer provide the screening intended by this condition as determined by
the Director of Community Development, the Authority shall promptly submit a
landscape plan that complies with Albemarle County Code § 18-32.7.9 and which
will provide screening as provided by Albemarle County Code § 18-32.7.9.7;
C. After the landscape plan is approved by the County, the Authority shall install and
thereafter maintain any landscaping shown on the approved landscape plan;
D. The Zoning Administrator may allow minor variations in the location of the
Landscaping Easement provided that the screening purpose of the Landscaping
Easement is satisfied; and
E. The deed of easement and easement plat for the Landscaping Easement shall be
subject to review and approval by the County before they are recorded in the Clerk's
Office of the Circuit Court of Albemarle County, Virginia.
2. If the Authority does not obtain the Landscaping Easement as provided in Condition 1, it
shall:
A. Submit a landscape plan that complies with Albemarle County Code § 18-32.7.9
and which will provide screening as provided by Albemarle County Code § 18-
32.7.9.7 to the equivalent extent practicable that would have been provided under
Condition 1, as determined by the Director of Community Development; and
B. After the landscape plan is approved by the County, the Authority shall install and
thereafter maintain any landscaping shown on the approved landscape plan.

Alan,
Matthew has signed off on the letter from the arborist and no longer has any objections; however, I need this
LOR revised to provide double staggered evergreens in the section highlighted in yellow (it looks like 6 more
plantings are needed in this area).
Once you complete this provide me four hard copies of the plan for County approval. The LOR won't be
approved till the easement plat (SUB2018-17 submitted by David Jordan, and comments provided March 19th)
is revised, resubmitted, reviewed, approved, and recorded. When the plat is submitted ensure the revised legal
docs are provided too, as ref in comment #1.
