The instrument was recorded in DB 5102, page 563. This completes the recording of the three instruments that involve easements shown on the Phase 1B Easement Plat. I'm copying David and Alan so they know this has been recorded, and so they have copies of the instrument the recording reference. I've also copied Anne Yost of our firm, who is a new paralegal in our office, and who will be providing lots of assistance with these matters going forward. Jeremy, you may have met Anne in the past, as she worked at St. John, Bowling and Lawrence several years ago. Once I have that I will record that instrument as well and circulate the recording receipt. Chris: I will wait to hear from you about the status of the County Attorney's and County Executive's signatures to the 6 instruments that go with the Phase 1B Subdivision Plat. Here is the rationale for the proposed changes: The plat that Mr. Perez presented to our office this morning is dated July 10, 2018. Therefore, I have changed the dates on both documents to reflect that the last revision to the plat is July 10, 2018. On the waterline easement, the document stated that the easement was "variable width", however, the July 10, 2018 plat shows the easement as 20 feet. Nicole, if these changes are acceptable to you, please make the amendments and send them back to me. I will sign them, and we will route them to the County Executive's office for signature. I offer the following explanation: The applicant of Rivanna Village mistakenly cleared all the trees in the existing 20' ACSA landscape easement and located a public storm drain through the middle of the easement. The preservation of the trees in this easement was a condition of Board of Supervisor's approval of the setback waiver for the ACSA water tower that is approved to be located on the County property. In order for ACSA to move forward with building of the water tower they need to plant the required landscape screening in the landscape easement to replace those trees which were lost. The location of the approved public storm drain is an obstacle to these plantings; however, Rivanna Village agreed to extend the landscape buffer on their property to permit the required plantings. Thus we have a final easement plat in our office for the expansion of the ACSA landscape easement, which does not need your review. But associated with this plat is the new 20' public storm drainage easement and a new 20' ACSA waterline easement, which crosses the County property. Ideally, I agree that it is preferable to include this easement in the plat when such information is available. However, since we are endeavoring to bring an expeditious conclusion to the Phase IB plat, we would like to proceed with the approval of the easement plat and the corresponding legal documents in their current state rendition. Most likely you will want to use the same deed as last time but have a supplemental addendum to it so it's linked to this new plat and the extension of the easement.
