3. [Comment] It is recommended that prior to approval of the plat that a revised LOR depicting
the proposal with the new variable width ACSA landscape easement is provided. Or provide a
separate exhibit showing the location of the 15’ storm drain, the plantings, and the location of the
landscape easement.

Chris,
The ACSA doesn’t have any issues with this revised plat. We will need to have a revised Deed of
Easement to complete this process. Will that be a requirement for approval of the plat? Also, the
ACSA will plan to resubmit our Glenmore Tank Letter of Revision with the updated Landscaping Plan
once this new easement is recorded. Does that work for you?

I just called Nicole Scro and received some insight and I offer the following revised comments:
1) Why is ACSA signing the plat? Won’t the deed suffice to ensure ownership of the easement? Did
they sign the initial plat creating the original 20’ landscape easement? Please explain the purpose of
ACSA signature on the plat?
2) The revised deed has been submitted and will be forwarded to the County Attorney.

The County Executive signed the legal docs in his purview for the proposal. I have placed them at the
front desk for you to pickup.
Please have the applicable owners sign and notarize the final plat and all associated legal
documents, then submit them to the County for approval of the final plat.
I will be out of the office for the next 11 days, if this is hot and needs to get done in that time frame,
submit it to the attention of Megan or Bill with this email attached.

Easement. Rev 1: The CL of the new 20' public storm drainage easement appears to relocate the storm drain
to the center of the existing landscape easement. This renders a worse outcome than previously, additionally
it renders the new landscape easement area pointless and unable to serve its purpose of planting evergreen
trees in the landscape easement without it interfering with the public storm drain.
[Comment] It is recommended that prior to approval of the plat that a revised LOR depicting the proposal with the
new variable width ACSA landscape easement is provided. Or provide a separate exhibit showing the location of
the 15' storm drain, the plantings, and the location of the landscape easement. Rev 1: Comment not addressed.
Based on the revisions it is more relevant than ever to provide the revise landscape plan/LOR prior to
approval of the easement plat.

not adversely affect the pipe, the plantings can remain as shown. Otherwise the trees will need to be outside of the drainage
easement.
Staff has provided references to the County Code. The Code is kept up-to-date by the County Attorney's office and
may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14,
if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this
letter, then the application shall be deemed voluntarily withdrawn. Please contact Christopher Perez at the Division of
