We will need to have a revised Deed of Easement to complete this process. Will that be a requirement for approval of the plat? Won’t the deed suffice to ensure ownership of the easement? Did they sign the initial plat creating the original 20’ landscape easement? This renders a worse outcome than previously, additionally it renders the new landscape easement area pointless and unable to serve its purpose of planting evergreen trees in the landscape easement without it interfering with the public storm drain. [Comment] It is recommended that prior to approval of the plat that a revised LOR depicting the proposal with the new variable width ACSA landscape easement is provided. Or provide a separate exhibit showing the location of the 15' storm drain, the plantings, and the location of the landscape easement. Rev 1: Comment not addressed. Based on the revisions it is more relevant than ever to provide the revise landscape plan/LOR prior to approval of the easement plat. ACSA Review Comments 1. The Code is kept up-to-date by the County Attorney's office and may be found at www.albemarle.org/countycode. In accord with the provisions of Section 14-229(B) of Chapter 14, if the applicant fails to submit a revised plat to address all of the requirements within six (6) months after the date of this letter, then the application shall be deemed voluntarily withdrawn.
