Ashley, I welcome any input you have about the "as well as the surrounding new poles" text. 3. Four trees were added in islands along the eastern end of the south side of the middle vehicle storage area. Can you explain why the planting wasn't extended along the full length of the south side of this storage area? The owner had a concern that the additional trees would require the loss of additional parking spaces, and that given the relatively thin line of sight into the property from the entrance along Rt. 29 (between the Better Living furniture building and the new landscaping and new service drop-off building addition), that what we show would be sufficient to screen the vehicles in that lot from the EC. 4. The area of vehicles awaiting repair is the location of an existing structure. Can you confirm that the structure will be removed to establish the storage area? Or will the vehicles be parked under that structure? The structure will be removed to establish the storage area. 5. Existing hardwood trees to remain are shown along the north side of the vehicles awaiting repair area. I didn't venture out to that side of the building when I visited the site. Aerials suggest that the vegetation doesn't come that close to the building and is mostly off-site. Can you confirm that there are still trees on-site in that area? I 1 do not have this information but we will coordinate with Shimp engineerg or assess it on site and get back with you quickly. Thanks for your help. It identifies the contract purchaser as Malloy Properties VI LLC and authorizes that LLC, Geoff Malloy and Valerie Long to submit land use applications on behalf of the owner. In Valerie's original email that I asked you to consider, she states that she would like to replace Malloy Properties VI with Malloy Properties III. If I understand you correctly, because we have the original "Authorization to Submit..." for Malloy Properties VI,Valerie's email is sufficient to accomplish to switch to Malloy Properties III and I the applicant's name can be updated in CountyView. Valerie forwarded your email to me and the pictures and upon further review I can confirm that the waterline is actually in the ROW, not on our property. For reference, the hydrant is about 2' or so on to our property, there is no recorded easement so I suspect it was just placed in the wrong location years ago and nobody noticed that it was actually on the parcel not the ROW. As far as our landscape goes, we are showing all of our EC required landscaping on our own property, so this waterline should not interfere with anything we have proposed. We may need to keep a little distance from the hydrant, but I think we have plenty of room in that corner to work. Hope this helps clarify, let me know if you need anything else. I have asked Joel to clarify whether his comments are requirements or recommendations, and I'll forward his response when I get it. Margaret VDOT,Joel DeNunzio: We have reviewed the special use permit application for Malloy Ford Outdoor Storage& Display and offer the following comments; 1. The Virginia Access Management Regulations (24VAC30-73-1 I0)states that commercial entrances may be reviewed and reconstruction, relocations, consolidation, upgrading,or a combination of these may be required if any of the following occur; 1) the property is being considered for rezoning or other local legislative action that involves a change in usc, 2) if the property is subject to a site plan or subdivision plat reviw, 3) there is a change (increase) in commercial use,or 4)circulation between adjoining properties becomes available. In order to comply with the Virginia Access Management Regulations, the entrances to TMPs 45-68C1 &45-68A should be consolidated allowing for a shared entrance to the two parcels. 2. Please provide both existing and proposed traffic generations as well as right-turn lane warrants. ACSA,Alexander Morrison and RWSA,Victoria Fort: I have reviewed the above referenced special use permit. It appears that the applicant is proposing landscaping along the Route 29 frontage. The ACSA and RWSA have water infrastructure in this area. My comments are as follows: • Show the existing ACSA and RWSA water infrastructure along the Route 29 frontage (see attached GIS Map). 1 mosk, t. • Show existing ACSA and RWSA easements. • Ensure no landscaping is proposed within existing ACSA and RWSA easements. Zoning, Ron Higgins 1. The Conceptual Special Use Application Plan shows a "body shop" use in the building closest to Berkmar Drive. Body Shops require a special use permit in the HC Zoning District. 2. All parking spaces should be marked, whether they are for off-street parking or display parking for vehicles. 3. Staff estimates the total cost of legal advertisement and adjacent owner notification to be between $400 and $450 per hearing. This estimate reflects the average cost of public notice fees for Special Use Permit applications, but the cost of certain applications may be higher. If applicable any fees for waiver/special exceptions will be required at the time the additional fees noted above are calculated. The current fee for a special exception is$457. It looks like the first set of comments for an April 18 submittal is June 3— not May 20. The scheduled ARB meeting date for applications received yesterday would be June 6,with staff's recommendations (the ARB staff report) sent out on May 30. Generally, a conceptual review follows the standard ARB schedule, but I'll modify dates as needed to maintain the SP schedule. If we need to move the ARB date to May 16 to maintain the SP schedule, I'll do that. But let's make sure we're clear on the SP schedule first. Please let me know where you found the May 20 date. We submitted the SUP application and ARB application this afternoon, so I expect it will find its way to you in the next week or so, and we hope it addresses your suggestions and feedback. To the extent you see anything major that you think we should change or is not clear to you, please do not hesitate to relay that to me and we will attempt to address it. I wanted to advise our client on the timing for the ARB's conceptual review, and how it relates to the SUP review schedule, and realized I was not sure how that would work. Will there be a meeting held before the staff comments are due to us on May 20th? If there is an ARB hearing date would you mind sending it to me? It seems like the conceptual reviews do not follow the typical ARB review schedule, but I'm not sure. Thanks for your help. Valerie Valerie W.
