Perez Date: June 23, 2016 Subject: Planned Parenthood—Mandatory Pre-application meeting 6-13-16 The following are County staff comments regarding the above noted pre-application meeting. This meeting satisfies the requirement for a pre-application meeting prior to submittal of your special use permit(SP) amendment application.The purpose of the meeting is summarized below: (i)provide the applicant and the county a common understanding of the proposed project; (ii) inform the applicant about the proposed project's consistency with the comprehensive plan, other relevant policies, and county regulations; (iii) broadly identify the planning, zoning and other issues raised by the application that need to be addressed by the applicant; (iv) inform the applicant about the applicable procedure; and(v) allow the director to idents the information the applicant must submit with the application, including the supplemental information delineated in subsection (c). Receiving the relevant supplemental information will allow the application to be comprehensively and efficiently reviewed. The following are staff comments for your proposal to amend condition#1 of SP1998-038 on TMP 06100-00-00-013A0 at 2964 Hydraulic Road. The parcel is zoned R-10, Entrance Corridor(EC), and has a SP w/conditions. The SP amendment application/review fee is$1,075. To facilitate these changes a minor site plan amendment will also be required to SDP2001-063. The minor site plan amendment application/review fee is $538 but will be waved when submitted together with the SP. Please submit both the SP and the minor amendment simultaneously, as the minor amendment will act as the concept plan for the SP amendment. (i)provide the applicant and the county a common understanding of the proposed project; The applicant proposes to disturb the undisturbed 15 foot buffer strip abutting Garden Court to remove the overgrowth of ivy and compromised trees, and install new screening trees and shrubs within this area. They also plan to install physical improvements within the buffer(a portion of the proposed brick patio,pervious pavers to serve the patio, 18 inch tall retaining wall, and 4 foot tall screening fence). The applicant also proposes to disturb the 15 foot buffer strip abutting the Townwood units in order to relocate and replace the existing six foot tall screening fence and install additional plantings in the buffer area. The following are part of the minor site plan amendment but do not require amendment to the SP: relocate the dumpster, omit 3 parking spaces, install a brick patio and seating adjacent to the building, and replant native shrubs within bio-retention basin. (ii) Consistency with the Comprehensive Plan • No apparent inconsistencies with the Comprehensive Plan goals or objectives have been identified. This site is within Neighborhood 1 of Places 29 and has a comp plan designation of Urban Density Residential which supports offices and service uses. (iii) broadly identify the plag,zoning and other issues raised by tpplication that need to be addressed by the applicant • Applications—To amend condition#1 of the SP to disturb the established buffers to adjacent properties requires a SP application and an Architectural Review Board(ARB)application. Margaret Maliszewski is your primary contact point for the ARB application. Christopher Perez is your primary contact point for the SP application. The proposal will also be required to go through the site plan process. It has been determined that this proposal may be processed as a minor amendment. Submit the minor amendment as the concept plan for the SP. • Landscaping- Landscaping will be of primary concern during the ARB review and the Planning/Zoning's review. Include as part of the minor site plan amendment a full landscape plan that complies with section 32.7.9 and complies with EC landscaping requirements and mitigates the visual impacts of the proposed improvements. • Parking Requirements—Because the site seeks to reduce the required parking onsite, provide a parking study which supports this reduction. The Zoning Administrator will review the parking reduction request with the application. Provide revised parking calculations on the minor site plan amendment. • Lighting- If existing site lighting is being modified or relocated, or if new lights are being added, then a lighting plan shall be required. Modified, relocated and new lighting must meet Zoning Ordinance requirements and ARB guidelines. Photometric plans shall distinguish between existing lighting to remain unmodified and proposed lighting. Proposals that increase nonconformities will not be approved. • Dumpster Location-The proposed location of the dumpster may pose a problem for vehicles servicing trash pickup as well as vehicles entering and leaving the site. This will be evaluated during the review of the plan. It may be appropriate to relocate the dumpster and /or reassess the site's waste pickup options based on the amount of waste generated from the facility. • Fire and Rescue was not able to attend the pre application meeting. It is suggested that prior to submitting a site plan that the applicant contact Fire and Rescue and determine if there are any issues with the proposal before making an application. (iv)Applicable procedures • SP application submittal with associated project narrative and minor site plan amendment (which will act as the conceptual plan), as described in the"Special Use Permit Checklist" (provided to you along with these comments). • Community Meeting—the applicant is required by the Albemarle County Code to hold a community meeting as part of the review of the SP request.The meeting shall be held no later than 30 days after submittal of the SP application. Upon request of the applicant County staff can provide a list of which nearby properties are required to be notified. Community meeting guidelines are attached. • If the applicant knows of any waivers or modifications that are needed to implement the proposed plan, staff recommends that those requests be submitted with the SP application. Staff will then determine if the waivers should be approved with the SP action or deferred for action with site plan approval. (v) Identify the information the applicant must submit with the application, including the supplemental information • Minor amendment Me site plan(which will act as the Conce plan)w/full landscape plan. • Attached pre-application checklist. This checklist will need to be filled in, signed, and submitted with the SP application. • Submit a separate ARB application with the corresponding checklist(for a conceptual plan/advisory review) at the time the SP application is made. • Parking study which supports the reduction in parking for the use. The changes in the landscaping which Planned Parenthood wants to enact will impact me and my fellow neighbors in section of Garden Court which abuts Planned Parenthood's property, so I want to put my comments down in writing. They are as follows:: 1. I am not pleased about the courtyard being placed behind me and my neighbor @ 1646. From what I understand, it will not be enclosed so the noise that will assuredly emanate from this courtyard will undoubtedly become intrusive to my peace and quiet as well as that of the neighbors in my section of Garden Court. If this courtyard is erected, then "QUIET!! signs will need to be put up and Planned Parenthood's staff will need to tell their clients to keep the noise to a minimum out of respect for the people living in the surrounding area. The best scenario for us to not to have the courtyard in the first place when it is so close to our homes. 2. I am also not pleased with the fact that the major large trees behind me and my neighbors to the right and the left (which serve to nestle us in from Planned Parenthood and from Townwood) will be removed. Placing viburnum and 8' dogwood trees behind us will do nothing to buffer our properties from that of Planned Parenthood. The land that our fences is on is much higher than the land in which Planned Parenthood wants to add these plantings. So if this re-landscaping is going to happen, then they will need to grade the land behind us so that the trees will be above the top of our fences and will provide some buffer, albeit not as much as we currently have. Putting in taller trees such as Spartan or Skyrocket Junipers. (16,00 would provide more of a buffer for privacy and sound muffling, so perhaps they will be considered these junipers as viable alternatives to the shorter trees and bushes. 3. The only thing that is acceptable to me about this re-landscaping is the fact that there will be lower lighting in the Planned Parenthood parking lot. Hopefully, the spillover will be less than it is now because the current lighting coming from the —30 tall pole lamps is very bright and shines directly into our backyards. 4. Hopefully, all of the beautiful English ivy in my backyard will not be ruined by this re-landscaping project Thank you for all that you do, Megan.
