County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESOP, (3) a SWMP, and (4) any TMDL measures necessary.
No SWPPP was included with the submittal and needs to be provided.

B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. The PPP appears to be acceptable at this time.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a
SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.

2. Due to two conflicting stream studies, Staff requests that a third study be performed, either by a
third party agreed upon by both the homeowners and the developer or by the US Army Corps of
Engineers. This third study will determine whether or not a buffer will be placed on the parcels in
question and on all parcels downstream of the site.
Comment addressed.
Include all necessary hydrologic and hydraulic analysis for the site, including the VRRM
worksheet for Redevelopment and verification the channel leaving the site is adequate.
Comment partially addressed. Include the Stormwater conveyance culvert on the LD-229
worksheet. STR-C3D to STR-C3 also appears to be entered incorrectly on the worksheet.
The nutrient credits will need to be purchased before plan approval. Please contact Ana
Kilmer for information on required documents and formatting. (Rev. 2) Please contact Ana
Kilmer prior to purchasing the 1.16 lbs. of nutrient credits.
4. Verify that the pipe profiles are correct. B2 and B3 appear to be shown and labelled incorrectly on
the profile view. The stub -out is not shown on C4.
Comment not addressed. Drainage information has been removed from the plan. Please
provide plan and profile information for the drainage system, including a drainage area
map for the inlets. Provide details on the weirs/orifices for the detention system and show
how the 60" and 72" pipes will be connecting to the MH-1s that are shown. (Rev. 2) Provide
more details on the JB-1's, including the height of the boxes and the type of tower on each.
It appears that both B2 and B3 are shown as being above grade, is this intended? (Rev. 3)

More detail will be needed where A4 and C4 connect to the retaining wall.
Comment partially addressed. Retaining wall/headwall designs will be needed before
approval. A4 also does not appear to continue through to the lower wall on the plan sheets.

6. A2 has a 4' drop and a 90' turn. Provide a hydraulic profile to verify this will work during larger
storms.

The curb cut on the turnaround is discharging runoff onto the fill slope. The slope will need to be
protected from erosion.
Comment partially addressed, the current grading shows a ridge in the middle of the swale.
(Rev. 2) Comment not addressed, the turnaround (located above ST-1) is still showing a
curb cut and hatching leading to the inlet. Provide more detail around the inlet as it
currently appears the drainage will not be intercepted by the inlet. The top is also called out
as 515.54 while the proposed 514 contour runs near the middle of the inlet and the 512
contour runs along the edge of the inlet, leaving A2 exposed. (Rev. 3) Comment addressed
8. Provide a Stormwater maintenance agreement for the site.
Response noted. (Rev. 2) The agreement has been forwarded to Ana Kilmer.
9. Provide plans for the retaining wall and verification that there is no issue with the wall and wall
foundation being submerged during storm events. It appears the 100yr storm event overtops the
wall and runs into the buildings and the neighboring property.
Comment partially addressed. Retaining wall plans will be required before approval as the

travelway and townhome construction is dependent on the walls and to ensure that wall
construction does not affect the neighboring property behind Lot 3. (Rev. 2) Response
noted. Retaining wall designs will be needed prior to plan approval. A grading permit will
not be issued until VSMP, road, and Final Site plans are approved.
10. (Rev. 2) All areas used as Forest and Open Space on the VRRM worksheet will need to be shown
and labelled as 'SWM Forest & Open Space Easement'. The following note will need to be placed
on the plan:
"The SWM Forest and Open Space Easement is subject to the guidance set forth by DEQ in the
Virginia Stormwater Management Program. The areas will remain undisturbed in a natural,
vegetated state, except for activities as approved by the local program authority, such as forest
management, control of invasive species, replanting and revegetating, passive recreation (e.g.,
trails), and limited bush hogging to maintain desired vegetative community (but no more than four
times a year)." (Rev. 3) Comment addressed
11. (Rev. 2) At the time of final plat submittal, a Deed of Dedication will need to be signed and
recorded for the SWM facility easements and the SWM Forest and Open Space easements. This
will filled out by the County and forwarded to the applicant when the final plat is nearing
approval.
12. (Rev. 2) Show parcels, owner and TMP information for all properties as they exist today. (Rev. 3)

D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESOP.
This plan is approved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Additional erosion control measures should be used below ST1 to ensure runoff does not enter the
neighboring property. Demonstrate how ST1 will function during construction. It appears that it
will be filled in almost immediately when the storm system and fill slope are installed.
Comment not addressed. Site does not appear adequately protected through all stages of
construction. It is also recommended that offsite grading easements are acquired when
grading within 5' of the property line. Please schedule a meeting to discuss how to move
forward. (Rev. 2) See comments below.
2. (Rev. 2) Show the full grading for the sediment traps on the plans. As shown, the proposed trap
elevations will not tie into the existing contours. Also show the drainage area to the traps. (Rev. 3)

5. (Rev. 2) For diversion dikes with slopes greater than 2%, the channel shall be stabilized in
accordance with Spec. 3.17, Stormwater Conveyance Channel. Show the type of stabilization and

The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction

conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
