Newberry SUBJECT/PROPOSAL/REQUEST: To amend the existing special use permit for a PRESENTER (5): community center to serve up to 200 children J.T. Newberry at any one time and to permit an approximately 2,800 square foot modular building adjacent to the existing basketball court. BACKGROUND: At its meeting on February 7, 2017, the Planning Commission voted 5:0:2 to recommend approval of SP201600022. Attachments A, B, and C are the Commission's action letter, staff report, and minutes, respectively. DISCUSSION: The County Attorney has prepared the attached Resolution to approve the special use permit. RECOMMENDATIONS: Staff recommends that the Board adopt the attached Resolution (Attachment D)to approve SP201600022, subject to the conditions contained therein. Development shall be in general accord with the concept plan titled "Southwood Boys and Girls Club Expansion" dated April 13, 2012 and the concept plan "Southwood Boys and Girls Club Expansion" dated January 27, 2017 (hereafter"Concept Plans") as determined by the Director of Planning and the Zoning Administrator. To be in general accord with these Concept Plans, the proposed buildings and uses shall reflect the following major elements within the site essential to the design of the site, as shown on the Concept Plans: • Location of buildings, uses, and structures, inclusive of the minimum setback for the structure from Bitternut Lane must be 15 feet(as approved under SP201200009) • Location of parking areas • Location of outdoor play area 2. Newberry BOARD OF SUPERVISORS: April 12, 2017 Staff Report for Site Plan Exception for SDP201700011 Boys and Girls Club Expansion #2 Following the Planning Commission meeting on February 7, 2017, staff determined that a site plan or site plan exception would be required for the proposed expansion at the Boys and Girls Club site because the request generated the need for additional parking. A parking analysis submitted by the applicant demonstrated four additional onsite parking spaces would be needed to accommodate the proposed increase in the number of children served (see Attachment A). On March 6, 2017, the applicant submitted a site plan exception request (see Attachments B and C). Under Section 32.3.5(a)(2), members of the Site Review Committee reviewed the site plan exception and found that sufficient information was provided to determine the proposal meets all of the applicable ordinances necessary to protect public health, safety and welfare. Section 32.3.5(a)(2) authorizes staff to approve a site plan exception "if the agent finds that unusual situations exist or that strict adherence to requiring the details in sections 32.5 or 32.6 would result in substantial injustice or hardship." In this case, staff does not find the proposal meets this high standard. However, given the limited scope of the impacts created by the request and the finding by the Site Review Committee, staff is supportive of the request under the Board's authority to consider it by special exception. Section 33.9(a) authorizes the Board to approve a site plan exception by special exception after considering "the factors, standards, criteria, and findings, however denominated." The Board is not required to make any specific findings in support of its decision. Additionally, the Board may "impose reasonable conditions to address any possible impacts of the special exception." RECOMMENDATION: Staff recommends that the Board adopt the attached Resolution (Attachment D) to approve the special exception to permit the development shown on the plan entitled "Southwood Boys and Girls Club Expansion #2" and dated February 21, 2017, subject to the following condition: 1. New onsite parking spaces shall not exceed the maximum grade of existing onsite parking spaces.
