ACTION AFTER RECEIPT OF COMMENT LETTER
Within 30 days of the date of this letter, please do one of the following:
(1) Resubmit in response to review comments
(2) Request indefinite deferral
(3) Request that your Planning Commission public hearing date be set
(4) Withdraw your application
(1) Resubmittal in Response to Review Comments
If you plan to resubmit within 30 days, make sure that the resubmittal is on or before a
resubmittal date as published in the project review schedule. The full resubmittal schedule may
be found at www.albemarle.org in the "forms" section at the Community Development page. Be
sure to include the resubmittal form on the top of your materials.
The application fee which you paid covers staff review of the initial submittal and one resubmittal.
Each subsequent resubmittal requires an additional fee. (See attached Fee Schedule.)
(2) Request Indefinite Deferral
If you plan to resubmit after 30 days from the date of the comment letter, you need to request an
indefinite deferral. Please provide a written request and state your justification for requesting the
deferral. (Indefinite deferral means that you intend to resubmit/request a public hearing be set
with the Planning Commission after the 30 day period.)
(3) Request Planning Commission Public Hearing Date be Set
At this time,you may schedule a public hearing with the Planning Commission. However, we do
not advise that you go directly to public hearing if staff has identified issues in need of resolution
that can be addressed with a resubmittal.
After outstanding issues have been resolved and/or when you are ready to request a public
hearing, staff will set your public hearing date for the Planning Commission in accordance with the
Planning Commission's published schedule and as mutually agreed by you and the County. The
staff report and recommendation will be based on the latest information provided by you with
your initial submittal or resubmittal. Please remember that all resubmittals must be made on or
before a resubmittal date.

By no later than twenty-one (21) days before the Planning Commission's public hearing, a
newspaper advertisement fee and an adjoining owner notification fee must be paid. (See attached
Fee Schedule) Your comment letter will contain the actual fees you need to pay. Payment for an
additional newspaper advertisement is also required twenty-two (22) days prior to the Board of
Supervisors public hearing. These dates are provided on the attached Legal Ad Payments for
Public Hearings form.
Please be advised that, once a public hearing has been advertised, only one deferral prior to the
Planning Commission's public hearing will be allowed during the life of the application. The only
exception to this rule will be extraordinary circumstances, such as a major change in the project
proposal by the applicant or more issues identified by staff that have not previously been brought
to the applicant's attention. As always, an applicant may request deferral at the Planning
Commission meeting.
(4) Withdraw Your Application
If at any time you wish to withdraw your application, please provide your request in writing.
Failure to Respond
If we have not received a response from you within 30 days, we will contact you again. At that
time, you will be given 10 days to do one of the following: a) request withdrawal of your
application, b) request deferral of your application to a specific Planning Commission date as
mutually agreed to with staff, or c) request indefinite deferral and state your justification for
requesting the deferral. If none of these choices is made within 10 days, staff will schedule your
application for a public hearing based on the information provided with your original submittal or
the latest submittal staff received on a resubmittal date.
Fee Payment
Fees may be paid in cash or by check and must be paid at the Community Development Intake
Counter. Make checks payable to the County of Albemarle. Do not send checks directly to the
Review Coordinator.

Thanks, Craig. I forwarded it to Zoning for their review (along with your earlier information) and they now have "no
objection" to the current application.
As far as the schedule for providing comments, I do think it makes sense to wait until after the Community Meeting, as
long as the applicant is okay with it. Ultimately, I think it could save time by providing a more linear path to the Planning
Commission. We would just look at the schedule to determine the timeline forward after the Community Meeting took
place.

Thanks, the Club continues to evaluate alternative options ... I am hoping to meet with them next week and understand
what direction they want to go. This only came about after the original submission... I'll let you know as soon as I hear
something. If you want to hold comments, I think that makes sense.
That being said, regarding the comments that were submitted, I offer the following responses:
1. A parking study was submitted (I'm attaching it to this email for your use) with the original application. Let me
know if you need additional hard copies to pass around.
2. Change will be made to 10' wide spaces. Will still be in accordance with recommendation of parking study.
3. No managed slopes are within the surveyed area of the project. There are some to the site's northwest, but this
will not infringe on those.
4. Building should meet the description of "industrialized building".

Do you have any update a Community Meeting date for this application?
One reason why I ask is that it is atypical for us to provide staff comments prior to the Community Meeting being held.
The goal is for us to incorporate any concerns that are raised at the meeting into the first round of comments, so they
can be addressed prior to resubmitting, if needed. Our expectation is that process takes place before a date with the
Planning Commission is scheduled.
So, according to the submittal date, we would issue comments by next Friday, 11/4. The resubmittal dates in
November/December would put this project on a Planning Commission agenda in January/February.
Do you think it could happen in mid-November?
I've attached comments from the Zoning Division.

Craig, the guidelines aim to mail notifications two weeks ahead of the community meeting date, however, I've
confirmed that in this case using the upcoming CAC meeting on the 20th meets the intent of the ordinance.
Have you already sent out the notice letters? If not, I'm can review it before it goes out to make sure it will meet the
other guidelines and Section 33.3.

Just as a head's up, the 5th & Avon CAC is meeting Oct. 20 at Southwood, mostly to get an update on the

I plan to provide the notification list for the community meeting by tomorrow, but I thought you might
appreciate the attached information beforehand. I've attached the meeting guidelines and a sample

Ideally, the meeting will be held prior to Friday, October 28th. I think holding the meeting at the Boys and
Girls Club makes the most sense, but let me know if that won't work for some reason.

Francis,
I saw you this morning at the ULI session and was interested to hear your thoughts on it. Additionally, I
wanted to say thanks for working with the Boys & Girls Club and accepting the application for the SUP.
That being said we are now in discussions of when to hold our community meeting. We will be reaching
out to the individuals within Southwood, but will also need to send out invites to those on the list that
you or the planner generates for the surrounding parcels.
What is your typical timeframe on sending that out, as we are working on trying to pick out dates to
hold the meeting.

Expansion
1. The applicant should provide a parking study that includes an analysis of parking demand
during a typical peak period of use in order to demonstrate that the proposed amount of on-
site parking is adequate to serve the expected increase in membership and staffing. At a
minimum, the analysis should include:
• The current number of parking spaces serving the site
• The number of new spaces to be added
• A count of the number of parked cars serving the use every 30 minutes over a 2 hour
period of peak use, 2 days a week over a 3 week period
• The anticipated increase in the number of members and staffing
• An estimation of the number of children and employees walking to the site or taking
transit and the staggered nature of pick up and drop off for Boys and Girls Club
activities
2. Please be advised that any parking spaces that are added in the new parking area must
comply with the dimensions listed in Section 4.12.16 of the Zoning Ordinance. For a 20' drive
aisle, the minimum width of the parking space is 10' and for a 24' drive aisle, the minimum
width is 9'.
3. Please include and label managed slopes on the application plan. If managed slopes are to be
disturbed, the disturbance must conform to the design standards listed in Section 30.7.5 of the
Zoning Ordinance.
4. Please clarify whether or not the proposed modular building meets the County's definition of
an industrialized building (see below) or if it is a mobile unit whose use is temporary in nature
(i.e. not installed on a permanent foundation). If the unit is temporary, it is subject to the
conditions outlined in Section 5.8 below.
Industrialized building:A combination of one or more sections or modules, subject to state
regulation, and including the necessary electrical, plumbing, heating, ventilating and other
service systems, manufactured off-site and transported to the point of use for installation or
erection, with or without other specified components, to comprise a finished building. For
purposes of this definition, a manufactured home is not an industrialized building. The
structure and use identified in this chapter as "temporary nonresidential mobile home"is an
industrialized building.

5.8 TEMPORARY NONRESIDENTIAL MOBILE HOMES
A temporary nonresidential mobile home may be authorized by the zoning
administrator provided the mobile home is necessitated to provide additional space for
employees, students or other people and is to be an activity area as opposed to being
employed for storage purposes or equipment which could be accommodate in an
accessory structure. Such mobile home shall be located on the same site as the main
established use for which additional space is needed. In the event of the expansion of
the main permanent structure, the mobile home shall be removed within thirty (30)
days of issuance of a certificate of occupancy for the permanent structure. Temporary
nonresidential mobile home permits shall be subject to the following conditions:
a. Administrative approval of site development plan after submittal to site review
committee;
b. Albemarle County building official approval;
c. The applicant and/or owner of the property shall certify as to the intent for locating
the mobile home at the time of application;
d. Skirting to be provided from ground level to base of mobile home within thirty(30)
days of the issuance of a certificate of occupancy.

Thanks, the Club continues to evaluate alternative options...I am hoping to meet with them next week and understand
what direction they want to go. This only came about after the original submission...)')) let you know as soon as I hear
something. If you want to hold comments, I think that makes sense.
That being said, regarding the comments that were submitted, I offer the following responses:
1. A parking study was submitted (I'm attaching it to this email for your use) with the original application. Let me
know if you need additional hard copies to pass around.
2. Change will be made to 10' wide spaces. Will still be in accordance with recommendation of parking study.
3. No managed slopes are within the surveyed area of the project. There are some to the site's northwest, but this
will not infringe on those.
4. Building should meet the description of"industrialized building".

Do you have any update a Community Meeting date for this application?
One reason why I ask is that it is atypical for us to provide staff comments prior to the Community Meeting being held.
The goal is for us to incorporate any concerns that are raised at the meeting into the first round of comments, so they
can be addressed prior to resubmitting, if needed. Our expectation is that process takes place before a date with the
Planning Commission is scheduled.
So, according to the submittal date, we would issue comments by next Friday, 11/4.The resubmittal dates in
November/December would put this project on a Planning Commission agenda in January/February.
Do you think it could happen in mid-November?

I saw you this morning at the ULI session and was interested to hear your thoughts on it. Additionally, I
wanted to say thanks for working with the Boys&Girls Club and accepting the application for the SUP.
That being said we are now in discussions of when to hold our community meeting. We will be reaching
out to the individuals within Southwood, but will also need to send out invites to those on the list that

A RESOLUTION SUPPORTING A
COLLABORATIVE REDEVELOPMENT PROJECT PROCESS
FOR THE SOUTHWOOD COMMUNITY
WHEREAS, the Southwood Mobile Home Park (Southwood), located on Hickory Street
south of 1-64 and east of Old Lynchburg Road in the Southern Urban Neighborhood, which is a
priority area within one of the County's designated Development Areas, currently has 341 mostly
substandard mobile homes and more than 1,500 residents representing the County's largest
concentration of substandard housing, and utilizing a larger percentage of County services than any
other single development in Albemarle County; and
WHEREAS, Habitat for Humanity of Greater Charlottesville (Habitat), which purchased
Southwood in 2007, expects its planned redevelopment of the 88-acre site to include the removal of
mobile homes, replacing them with a variety of different site-built unit- type homes in a manner
consistent with its non-displacement pledge, resulting in approximately 400 new affordable housing
units; and
WHEREAS, Habitat, having already invested more than $2 million on deferred and
emergency maintenance - including road improvements, sewer system upgrades and emergency
electrical repair- recognizes that extensive additional infrastructure improvements will be needed
which may be in excess of its capability to fund without assistance; and
WHEREAS, through its Strategic Plan and Comprehensive Plan the County is committed to
engaging actively in redevelopment and revitalization in the County's Development Areas with
acknowledgment that a successful project of this magnitude and complexity requires extensive
collaboration and coordination among the project developer, affected residents and public agents,
including County staff and officials; and
WHEREAS, Albemarle County, as part of supporting this project, may wish to consider
targeted investments in public infrastructure including, but not necessarily limited to specific roads,
trails and park land for public benefit, as well as innovative land use development strategies
supported by the County's Comprehensive Plan; and
WHEREAS, strategic investments in Southwood are intended to result in significant returns
including, but not limited to, high-quality affordable housing units, additional employment
opportunities, increased tax base, and reduction in the high demand for County services.
NOW, THEREFORE, BE IT RESOLVED by the Albemarle County Board of Supervisors that
the Southwood redevelopment project represents an essential public/private partnership opportunity
that is consistent with the Comprehensive Plan and the County's broader strategic goals, the
success of which is greatly influenced by the extent and quality of active engagement between
representatives of Habitat and representatives of the County, including County staff; and
BE IT FURTHER RESOLVED that the effective redevelopment of Southwood according to
the core values of non-displacement and sustainability is a critical component of successfully
working with a concentration of the County's most vulnerable population that could serve as a
blueprint for future revitalization and redevelopment of the County's aging suburban infrastructure.
