Clint,
No I have not installed any new lighting. Motion lights are located at the front office door, rear entry door and
the two corners of the building facing innovative but light is directed down toward the parking area.

Hey Clint,
I've got one comment and question on the LOR.
1. Section 32.5.2(a)—On Sheet 1, please add a note regarding the approval of the special use
permit(SP201600021)and note the conditions of approval (see attached). Something like "On
February 8, 2017,the Board of Supervisors approved SP201600021 subject to the following
conditions: ..."
2. Section 32.7.8—I recall there was existing outdoor lighting on the site and we should note it on
the LOR. Was there any new lighting proposed (or installed) since occupying this site?We have
some standard lighting notes for site plans to document existing fixtures and whether or not
they are subject to Section 4.17 (Lighting Ordinance).Aren't there just existing wall pack fixtures
on the building for lighting on the site?
I'm going to double-check these changes with Lisa to confirm they are sufficient for continuing with the
abatement of the zoning violations.

Can you please let us know if the LOR/SPA has been approved,or when that approval will likely be
granted?
As you know, court dates for the zoning violations continue to loom, so Tommy is looking to install the
proposed screening trees and gate per the LOR as soon as possible. I advised that he wait until approval
was officially granted on the off chance that additional revisions would be requested.

This checklist must be completed,signed and submitted with the application. The information contained in this checklist
reflects the contents of the Section 32 of Chapter 18 of the Code of the County of Albemarle also known as the Site Plan
Ordinance as of January 1,2013. The applicant is responsible for insuring that no revisions to the Ordinance have
occurred since preparation of this document
Plans which lack the information required by this checklist shall be deemed to be incomplete and shall be denied by the
agent with ten(10)calendar days after the applicable submittal deadline[Section 32.4.21.
An Initial Site Plan shall contain the following:

The Special Use Permit Narrative has been revised to include the following:
CONSISTENCY WITH ZONING ORDINANCE SECTION 26.3
The requested use "Auto Repair" is considered a general commercial use per the
Albemarle County Zoning Ordinance. As such, section 26.3, items a.-f. Have been
considered:
a. The requested use will meet the purpose of the industrial district by
supporting existing industrial uses. The requested use of Auto Repair will
ensure that Tommy Shull's Wrecker and Repair can continue to be competitive
in the marketplace by providing a service which supplements the industrial
uses of towing, and body shop. Doing so will strengthen the local economic
base and will ensure that Tommy Shull's Wrecker and Repair can continue to
provide employment opportunities to members of the community in the
future.
b. The existing building size is consistent with the intent of the light industrial
district. The building, as approved in SDP 66, is sized appropriately for its
intended industrial use, and supporting uses.

C. The requested Auto Repair use will not displace, or be detrimental to the
existing industrial uses. As a wrecker service, the services are mobile by
nature and do not require large amounts of building square footages to
operate. The building area used for auto repair will only serve to strengthen
the primary wrecker and towing service.
d. The gross floor area of the existing building is approximately 2,550 SF.
e. The activities of auto repair will utilize an area which is 25% or less of the
gross floor area.
f. The building on site is existing. All applicable permits have been obtained
related to building construction standards.
2. Please ask the applicant to review the performance standards within §5.1.31.
a. §5.1.31 (a) requires all parts, materials and equipment to be located within an enclosed
building. The proposed plan shows temporary part storage in the rear of the property.
b. §5.1.31 (b) requires that vehicles awaiting repair not be visible from the adjoining
residential district. If this standard cannot be met, the applicant should either find a means
to address it or submit a special exception to be processed with the special use permit. An
assessment will need to be made as to whether the property to the rear is adequately
screened. If not, it may be necessary to obtain an easement on the adjoining property to
provide sufficient screening.
Per ARB request to reduce/eliminate visibility of any parts stored from the entrance
corridor, a note has been added to the Letter of Revision as well as the SUP
Application Plan which reads "Height of parts stored shall not exceed 5'." To
clarify, the applicant does not intend to use the secured parking area as parts
storage. The only parts that will be stored will be associated with the vehicles
temporarily stored in this area. For instance, a vehicle involved in an accident
which is temporarily stored, may have a detached fender which would also be
temporarily stored in the designated area.
Adequate screening currently exists along the rear property line. The adjoining
residential lot, TMP 90-35F, is currently covered almost entirely with dense
vegetation. The existing structure on the lot is approximately 450' from the rear
property line (please refer to the image below). A portion of the dense vegetation
lies within the Shull's property as shown on the Letter of Revision Plan.

3. Please explain the diagonal hatching on the rear vehicle storage area.
The diagonal hatching indicates the designated, temporary parts storage area.
4. Please explain the reference to the secondary garage door. Isn't this door discontinued
because it's in conflict with parking and the exhaust vent?
The two garage doors are in place as shown on the Letter of Revision Plan. The
exhaust vent is situated just to the west of the "secondary" garage door.
5. Prior to this use beginning, the engineer's report must address all aspects of the body
shop work as well as the mechanical repairs. A paint booth typically requires DEQ
approval.
Acknowledged. An engineer's report will be furnished. It is our understanding that
given the limited capacity of the proposed paint booth, less than 1 .5 gallons of
paint a day, the booth is considered a touch up booth and not a fully functioning
booth. This type of booth is subject to less permitting requirements.
6. The applicant is advised to follow-up on inspections and any other outstanding
information relating to the building permit for creating an indoor paint spray room. I can

find no record of inspections since the preliminary zoning inspection in August. (B2016-
1505AC).
All proper permits have been, or will be obtained prior to the requested use
beginning.
7. The applicant is advised to follow-up on any outstanding information relating to the
zoning clearance application. It appears to still be pending. (CLE2015-0157). For the
current towing and body shop use to be in compliance, this clearance should address that
use and be pursued by the applicant until approved.
