To whom it may concern:
We are including in this letter of revision all of the information you need to be aware of that will be
changing with the above referenced project we have also included separately 4 copies of plan sets that
reflect the necessary revisions.
A 5'tall chain link fence around the perimeter of the property has been added to the plan. This
includes a sliding gate, fitted with screening slats located approximately 60' from the front
property line which creates a secure parking and vehicle storage area.
1. Customer and employee parking locations remain in the same general locations, however the
parking space alignments have been revised.
�3. A service vehicle parking area has been delineated near the northeast corner of the parcel.
,1 I sign post, and 30"X48" sign has been added near the entrance to the parcel.
o8''. Towed vehicle storage and temporary parts storage has been delineated at the rear of the lot.
/l A 31'X19' concrete dumpster pad and dumpster has been added near the south east corner of
the parcel.
White pine screening at the rear of the lot has been replaced with a densely vegetated, 5' chain
• link fence as well as a tree line just beyond the fence of dense vegetation.
Company vehicle parking has been delineated within the secure parking area, along the northeast
property line.
\91: A metal exhaust vent has been added to the front corner of the proposed building.

I wanted to check in with you and give you a status update on our submittals:
We are on track to submit the letter of revision this week, and the special use permit either this week or early next
week. Please find the attached, advance copy, of the Letter of Revision Plan. This will accompany a letter, detailing
the revision depicted in the plan. I wanted to give you an opportunity to review it. Please let me know if there are any
omissions that jump out at you, or any revisions that you would like to see implemented on the plan. Once I receive
your feedback, I will be running the plan by Margaret Maliszewski of the Albemarle County Architectural Review Board. I
am hoping to incorporate her input into the L.O.R. in an attempt to expedite the review process.
We will follow up the L.O.R. submittal this week with the SUP submittal as well.
Also, please find the attached L.O.R. application. A fee check of$108 is required. I can swing by and pick it up, or you
can drop it off here at our office, whichever you prefer. Please note I left the"Applicant" portion blank. I was not sure if
you, the owner, or the manager wanted to be considered the applicant on this.

This notice is to inform you that the above-described Property is in violation of the Albemarle County
Zoning Ordinance. This conclusion is based on the following observations of the above-described Property
by a Code Enforcement Officer on September 13, 2015 as well as on information provided in an August 3rd
preapplication conference with County staff:
1. The operation of an automotive repair shop on this parcel is not a permitted
use.
2. Changes to the site are inconsistent with the latest approved site plan dated
August 6, 1973. These include changes to parking area,fencing and the
addition of a building(see#7).
3. Changes to the site do not have a certificate of appropriateness.
4. The "towing and wrecker" business has commenced operation without an

6. The operating of an industrial use, including a paint booth,without an

Because this use of the Property or structure did not pre-exist the applicable Zoning Ordinance,it cannot
be considered legal but non-conforming use or structure. Accordingly,the following sections of the Zoning

These violations of the Zoning Ordinance are unlawful, and may be subject to civil penalties, criminal
penalties, injunctive relief andlor other remedies,pursuant to Albemarle County Code § 18-36.
This letter also serves to notify you to stop the.activity or use outlined above immediately. Failure to
comply with this notice may result in legal action being taken against you and any o tenant or
other responsible party. In addition, you must bring the property into compliance by o
avoid court action. Future compliance past this date does not preclude the County from pursuing legal action
for existing or past violation(s).
If you are aggrieved by this determination, you have a right to appeal it within ten (30) days of this
notice, in accordance with Virginia Code § 15.2-2311; provided, however, that a ten(10) day appeal period
applies to appeals of decisions pertaining to temporary or seasonal commercial uses, and such appeals shall
be filed within ten (10) days after this decision. If you do not file a timely appeal, this determination shall
be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and the
Board of Zoning Appeals, in accordance with Albemarle County Code § 18-34.3, along with a fee of$240
plus the actual cost of advertising the appeal for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the Department
of Community Development located at 401 McIntire Road, Charlottesville, Virginia 22902 or online at
www.albemarle.org/cdapps. This form applies to appeals of decisions of the zoning administrator or any
other administrative officer pertaining to the Zoning Ordinance.
Regulations pertaining to the filing of an appeal to the Board of Zoning Appeals are outlined in
Albemarle County Code § 18-34.3, which may be reviewed online at www.albemarle.org/countycodebza.
