The Ordinance requires the applicant to defer to a specific Board date for an action on the ZMA. I'm advising my applicant to request deferral of the Board's action for the full period allowed under the ordinance (up to 36 months, which would be October 3, 2021 for this ZMA). You will still be able to re -submit at any time earlier than that even if you request the full deferral length, it just gets us off the shot clock for the 90 day PC action and subsequent Board action. So, you can either specify the full length deferral (36 months), or an earlier date. Please respond and give me an exact date as you see fit. There is no way that it could get re -submitted and reviewed by us in time for the staff report writing and getting the information packets to the PC for the December meeting. A deferral request also gets us off the hook from the Planning Commission action 90 day deadline. Of course, that 90 day deadline may not be an issue anymore if the BOS acts on the waiver request two weeks from now. We'll just have to wait and see. You can make the deferral request through an email. Just let me know if that's what you want to do. Please be aware that the County's Ordinance has recently changed in terms of the timeline for Planning Commission action on ZMA applications. Within 90 days from the date of the application submittal, the PC must act on a request for ZMA approval. As such, this application has been tentatively scheduled with the PN on December 18, 2018. All this being said, the Board of Supervisors may choose to waive the public hearings, this has been scheduled on their November 14 agenda. The 90 day timeline would no longer apply in that case. All this being said, please review the "Action After Receipt of Comments" portion of the letter. There are some edits that need to be made to the draft proffer statement, and requesting a deferral of the PC action will allow you time to make the edits and resubmit to us for review (regardless of whether the BOS waives the public hearings or not).
