County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
the items below are satisfactorily addressed. The VSMP application content requirements can be
found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. SWPPP was not provided. Two copies of SWPPP required before plan approval. See template at
link below. Ensure that #1 and #9 are signed.

B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.

C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a

SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. Cover sheet should not say Final Site Plan. This is the WPO VSMP Plan. Please revise. Include
the WP0201800029 number. Rev. 1: Cover sheet still says Final Site Plan. Rev. 2: Comment
addressed.
2. Provide explanation or outline of compliance with stormwater quantity and quality requirements.
Is project grandfathered? What is the approved plan number for the existing pond? Since use of
the existing pond is proposed with this plan, provide information showing that the pond was built
as designed on the approved plan. Also, show that the proposed drainage area to the pond meets
the design on the approved plan. Rev. 1: This plan cannot be approved until the amendment
to WP02006-00048 is approved. Also, nutrient credits (if going that route) must be
purchased before plan approval. Be sure to contact Ana Kilmer (akilmer(aalbemarle.org or
434-296-5832 ext. 3246) before purchasing the credits. Rev 2: Comment still valid. Rev. 3:
Comment still valid. Plan can be approved, however land disturbance will not be issued
until nutrient credits are purchased.
3. Stream buffer is shown on plan along with improvements/grading in this buffer. Please show
proposed buffer outside of all improvements. The gravel trail can be inside the buffer. Rev. 1:
The grading near the stream is too extensive. This is a perennial stream, which should have
a 100 ft. buffer. The original plan had minimal impacts to the 100 ft buffer, which was
allowed by the County Engineer and was discussed with the applicant at that time. Rev. 2:

4. [Section 8 — Design Standards Manual] Slopes steeper than 3:1 must be permanently stabilized
with landscaping vegetation hardier than grass, which will not require mowing. Ensure this is
noted on the landscape plan. Eliminate any slopes steeper than 2:1. Rev. 1: Comment addressed.
5. Stamped, engineered design may be necessary for retaining walls. Provide more detail to
determine (tops, bottoms, etc.). Show geogrid location (as necessary). Rev. 1: Provide enough
spots to ensure the design requirements of County Code 30.7.5.a are met. Also, provide 3 ft
horizontally between each wall. Rev. 2: Code 30.7.5.a says, A minimum horizontal
distance of three (3) feet shall be maintained between each individual wall. The plan
currently shows 3 feet from the outside of each wall, not between them. Rev. 3:

6. Provide drainage divides to proposed storm inlets. Rev. 1: Comment addressed.
7. Show throat length for drop inlets on storm profiles. Rev. 1: Comment addressed.
8. Note #13 on the cover sheet states that additional stormwater quality may met by purchase of
nutrient credits. Please elaborate. How is water quality met on site/with existing pond? How
many credits are necessary? Rev. 1: This plan cannot be approved until the amendment to
WP02006-00048 is approved. Also, nutrient credits (if going that route) must be purchased
before plan approval. Be sure to contact Ana Kilmer (akilmer(aalbemarle.org or 434-296-

preserved slopes. Be sure to show the outlet protection calculation and provide an easement
for the pipe offsite. Rev. 2: It appears silt fence is shown going through the preserved slopes.
The only disturbance should be for the pipe outfall. The pipe outfall at the water surface
elevation is ok. Rev. 3: Comment addressed.

12. Rev.l: Provide storm drain calculations. Rev. 2: The maximum velocity the county is

14. Rev. 1: Slope from CF -2 to EW -1 is too steep. Per VDOT drainage manual 9.4.8.7,16% is

15. Rev. 1: The plan amendment is for WPO2006-00048, not WPO2005-0007. Please revise the
narrative on Sheet C6.1. Rev. 1: Provide details and maintenance requirements for

16. Rev. 2: [Sheet C6.11 Narrative refers to pre-developed/post-developed flows shown on the
WPO amendment. However, these numbers are not shown on the amendment? Narrative
also references a portion of the site that does not drain to the pond. Show the drainage
area/calcualtions for this area to match up with the flows presented on the plan. Rev. 2:

17. Rev. 3: Please provide a new application form. The old application has the previous
engineer's information on it. The fee has already been paid, just need a new form.
D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP.
This plan is approved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
1. Limits of clearing and grading should be outside of all proposed work. This includes silt fence.

2. Show the limits of clearing and grading on the demolition plan sheets. Rev. 1: Comment

3. Is tree protection necessary for any of the existing trees? Rev. 1: Comment addressed.

Velocity calculations show 16.1 ft/s, which would require class II per the detail? However, class Al is

The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.

request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need
to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
