This letter is in response to the attached LOR request letter dated October 19, 2018. The Department of
Community Development hereby grants approval of a LOR for the following modifications to SDP2017-
16, which are described below:
1. Modify the sidewalk along Old Lynchburg Road as depicted on the attached sheet C3.
2. Modify the fencing dimensions around the tot lots, provide crosswalk painting, and modify
handicapped parking painting/striping.
3. Allow the recreational equipment in the tot lots to be swapped out for equipment depicted in
the BYO Recreational attachment.
4. Revise the landscape plan by omitting the Palmore Ash trees along the 1-64 and replacing them
with London Plane trees as listed on the attached sheet C21.
This is the second LOR for this site. Three LORs are allowed, after which all required changes must be
submitted as a site plan amendment.

This letter is serving as a request to change the following items on the approved site plans called
`Timberland Park Apmts':
1. Move the sidewalk proposed along Old Lynchburg Road to be along the back of curb to match the
other sidewalks that have been installed in the immediate area since this plan was approved (see
revised sheet C3). Making this change will improve three things:
a. There is a telephone pedestal located right in the way of the current proposed location.
This will no longer be in conflict and will eliminate the need for a jog in the sidewalk.
b. The slope coming down from the proposed site currently would have its toe of slope up
against the sidewalk. By moving the sidewalk to the back of curb, this will give a buffer
between this toe of slope and the sidewalk which should help with future maintenance and
moisture collection on this sidewalk.
c. Functionally, since all the other sidewalks in the area are up against the back of curb, it
seems we may want to adjust as well to better accommodate future crosswalks. We have
noticed a high usage of these sidewalks already and currently people cross the street where
the sidewalk on the other side ends at the guardrail, which this spot has limited visibility
around the curve of the road.
2. The tot lots are not able to fit the swings with appropriate safety zones within the 2,000 square foot
area. These tot lots are very restricted by grade around them and cannot expand any to fit the
swings. The playground supplier, BYO Recreation, has provided us a playground set and benches
for each playground that exceeds the child accommodation required by the County. The County's
requirements accommodate 25 children and the proposed playgrounds accommodate more than 50
children within the safety guidelines. A layout plan has been provided showing the final layout
and amenities of the playground as well as the final dimensional layout of the 2,000 square foot
fenced area. (See revised sheet C3 and BYO Playground Plans)
3. The landscaper suggests that we do not use the Palmore Ash along the I-64 screening due to their
survivability rate in this area. They recommended the London Planetree as a substitute. The
London Planetree is of equal size and cover. (See revised sheet C21)
