So your pursuits haven't been in vain. Per the Dunlora Park Phase 2 Final Site Plan the developer is to construct sidewalk along Rio Road within the existing RW. The County will be constructing only the new curb &gutter along the street. Based on our conversation it was my understanding that the developer's sidewalk would likely be built prior to the County building the curb &gutter. Thus my previous comments for and the note that was provided on the developers Site Plan that the developer must field check and document the elevations of the formwork, etc. prior to pouring concrete. Also should this occur prior to the County's work,we wouldn't need a temporary grading easement. However, should the County build the curb &gutter prior to the developer's sidewalk and site improvements (i.e. grading) we would need a temporary grading easement from the developer. The line highlighted below in "yellow" represents the proposed fill slope limits and the dash & double dot line is the temporary construction easement. Therefore, a note was provided on the Final Site Plan stating "proposed temporary grading easement upon demand of the County". Based on our last conversation I believe you were thinking of including the temporary easement on the subdivision plat rather than waiting for us to make a "demand" at a later date. Jack M. Kelsey. I seriously doubt the developer of parcel 13 (proposed to be subdivided under SUB2018-00153)is under obligation to show a future RW needed to construct sidewalk unrelated to the subdivision. The Rio Road sidewalk project is,to my knowledge, independent of Dunlora Park Phase II subdivision plat. I recall one parcel at least on Barracks Road changed ownership during design work on a county-VDOT sidewalk project, and Albemarle had to acquire easements from current owner/s. In short,I do not believe Planning or Engineering should request or require the subdivision Applicant to provide RW(yellow highlight,below)that we realize is required for the future county-VDOT sidewalk project. The revised plans are hereby submitted incorporating the following changes in response to the items in your letter. Planning 14. The WPO amendment shall be resubmitted for the improvements herein. 27. The application acknowledges this requirement. Engineering General 1. The applicant acknowledges this requirement. The VSMP plan has been resubmitted for final approval. 2. The applicant acknowledges this requirement. The applicant is working on the final subdivision plat. 3. The applicant acknowledges this requirement. A bond estimate will be requested. Sheet 3 4. Guardrail has been added to the plan design. The guardrail shall be installed on the back of curb, as required by VDOT. In addition, a retaining wall and 6' shoulder has been provided along the Lindley Court. This design meets VDOT standards and requirements. 5. The guardrail has been installed along the alley as requested. See sheet 3. 6. The(5)trees have been removed to avoid conflicts with the guardrail. These trees were not needed for the overall tree canopy on the project. 7. The yard drains have been removed from the project. The grading for the units have been adjusted with the Rio Road improvements to provide positive drainage away from the units. 8. Speed limit signs have been added to the alley. 9. The radii, Pc/Pt information has been added to the roadway to aid in construction and plan review. Sheet 4 10. The yard drains have been eliminated from the project. 11. Roudabush and Gale performed a slope analysis and submitted a report to Albemarle County on the location of the preserved slopes on the property. These slopes have been inserted into the design and used during the Phase I construction and this phase. These slopes do not match what is in the field,as the contractor extended the grading into these areas during the Phase I construction. They have recently fixed these areas and installed mitigation planting in these areas. Regardless, our design illustrates the limits of the preserved slopes as 4 %We `41110 established by the analysis for Phase I. We are also installing a retaining wall to help ensure no additional disturbances will occur in these areas. 13. Noted, see response for number 12. 14. A plan sheet has been added for the design of the underground detention facility. This sheet is consistent with the VSMP amendment's plan sheet. Additionally, Contech has confirmed this design is acceptable and is expected to operate in accordance with Contech Engineered Solutions' design intent. 15. The proposed grading has been updated and is correct and accurate with the design. 16. A retaining wall has been installed along the alley to help ensure protection of the preserved slope areas. 17. The details are no longer needed since the yard drain design has been removed from the plans. Sheet 6 18. The typical section has been revised accordingly. 19. However, if the trees are planted between the curb and sidewalk the tree strip needs to be at least 6' as Scott notes below. If the trees are planted behind the sidewalk there will need to be a 4' buffer strip (VDOT minimum for Revenue Sharing projects) between the curb and sidewalk and adequate right-of-way behind the sidewalk. I'm not sure if there's a standard for what is adequate behind the sidewalk, but I'd assume 6' (similar to a tree strip)to allow the trees to be planted 3'from the sidewalk and the remaining 3'for tree growth and future maintenance(i.e.cut down when they're too large or die and replant). Whichever you decide just make certain you transition to our typical section as you approach your southern property line. There is one item I do need to add. Since it appears your sidewalk will be constructed before we build the curb&gutter, it is critical that your sidewalk elevations along its entire length adhere to our top of curb elevations plus the VDOT standard cross slopes for the buffer/tree planting strip and sidewalk. To assure this please add the following note to the site plan: "Developer will field check and document the elevation of the sidewalk formwork based on the most current Albemarle County Rio Road Sidewalk plans and obtain Albemarle County Project Management Division approval of the formwork elevations prior to pouring the concrete. Attached is the comment from Jack Kelsey about the location of the trees verses the sidewalk, and also 111119 attached is the sidewalk design by Timmons Group. As you can see from the plan design,TG has designed the sidewalk with a 4'grass strip between the sidewalk and back of curb. This is not wide enough for street trees. We can show the sidewalk with a 6' planting strip across our property and install the street trees between the sidewalk and the curb, but this will create a jog in the sidewalk and the street trees will be located within the clear zone on Rio road (an Albemarle County collector road). As far as the street trees not having enough room in the right of way on the back side of the sidewalk,we can always create an easement for the street trees,that's easy. Chris is correct as we are not interested in requesting a waiver for the project. And on the flip side,this streetscape design is not our design. Please let me know which direction we should go,whether to keep the design as is, with a landscape and maintenance easement on the back side of the sidewalk for the street trees outside of the r/w or show the sidewalk shift to install street trees between the curb and sidewalk(within a 6' planting strip)along Rio road. The Covenants and Restrictions document will cover the maintenance of these plantings. However, if the trees are planted between the curb and sidewalk the tree strip needs to be at least 6' as Scott notes below. If the trees are planted behind the sidewalk there will need to be a 4' buffer strip (VDOT minimum for Revenue Sharing projects) between the curb and sidewalk and adequate right-of-way behind the sidewalk. I'm not sure if there's a standard for what is adequate behind the sidewalk, but I'd assume 6' (similar to a tree strip)to allow the trees to be planted 3'from the sidewalk and the remaining 3'for tree growth and future maintenance (i.e. cut down when they're too large or die and replant). Whichever you decide just make certain you transition to our typical section as you approach your southern property line. There is one item I do need to add. Since it appears your sidewalk will be constructed before we build the curb &gutter, it is critical that your sidewalk elevations along its entire length adhere to our top of curb elevations plus the VDOT standard cross slopes for the buffer/tree planting strip and sidewalk. To assure this please add the following note to the site plan: "Developer will field check and document the elevation of the sidewalk formwork based on the most current Albemarle County Rio Road Sidewalk plans and obtain Albemarle County Project Management Division approval of the formwork elevations prior to pouring the concrete. This pushes the sidewalk outside of the existing right-of-way so the dedication of additional right-of-way (1' minimum off the back of the sidewalk) is necessary. The final site plan flip-flops the sidewalk, in other words the street trees are shown behind the sidewalk so that the new sidewalk stays within the existing right-of-way. As you mentioned in our meeting this would require a waiver from the Code requirement,which you thought the developer wasn't interested in pursuing. The street trees are also shown within the existing right-of-way, but the space between the sidewalk and the right-of-way gets very narrow on the southern end.
