THIS DEED,made and entered into this 18th day of July,2001,by and between
ROBERT M.MUSSELMAN and CAROLYN C.MUSSELMAN,Trustees of the
WOODBOUND FARM LANE)TRUST,u/a dated December 31,I998,hereinafter referred to as
the Grantors,and TIMOTHY MACDONNELL and PATRICIA MACDONNELL,husband and
wife,whose address is P.O.Box 624,Keswick,Virginia 22947,hereinafter referred to as the
Grantees,
WITNESSETH:
That for and in consideration of the sum of Eighty-Nine Thousand Three Hundred Forty-
Three and 50/100 Dollars($89,343.50),of which Thirty Thousand Dollars($30,000.00)is cash
in hand paid,receipt of which is hereby acknowledged by the Grantors,and the balance of Fifty
Nine Thousand Three Hundred Forty-Three and 50/100 Dollars($59,343.50)is evidenced by a
Deferred Purchase Money Note secured by a retained Vendor's Lien,the Grantors hereby
GRANT,BARGAIN,SELL and CONVEY with SPECIAL WARRANTY OF TITLE unto the
Grantees,as tenants by the entirety with full rights of survivorship as at common law and not as
tenants in common, the following described property:
All that certain lot or parcel of unimproved land,in the Rivanna Magisterial
District,Albemarle County,Virginia,located off Interstate 64,designated as
Lot B,containing 21.022 acres,on a plat of survey made by Thomas B.
Lincoln Land Surveyor,Inc.,dated April 27,2001,which plat is attached to
and made a part hereof;BEING a division of Tax Map 94 Parcel 37 on the
tax maps of Albemarle County.
The said property is a portion of Parcel Third conveyed to the Grantors by Deed of Gift of
Robert M.Musselman and Carolyn C.Musselman,his wife,dated December 31,1998,recorded
January 6,1999,in the said Clerk's Office in Deed Book 1777,Page 338.
The Grantors retain a Vendor's Lien on the property hereby conveyed to secure the
Deferred Purchase Money Note for the balance of the purchase price. The said Note is payable in

full on November 18,2001,with monthly installments of interest only at eight percentum(8.0%).
The conveyance of the 21.022 acre tract includes as appurtenant to it a non-exclusive
easement or ri,,ht-of-way for ingress and egress,fifty feet in width and running along the path of
the existing road from the Frontage Road leading to State Route 616(State Route F-181,also
known as Woodbound Road)to the junction of the said right-of-way with a certain parcel of
21.83 acres conveyed to Robert A.Wilson and Elizabeth K.Wilson by deed dated June 1,1982,
recorded in the said Clerk's Office in Deed Book 739,page 651,with plat at page 653,and then
along the southern boundary of the said 21.83 acre parcel of to the junction of the said existing
road with a continuation of the said right-of-way across property of William Joseph Berman and
Margaret Susan Berman which right-of-way was reserved in a deed to them recorded in the said
Clerk's Office in Deed Book 706,page 379,with plat at page 384,to a point parallel to the
eastern boundary of the property hereby conveyed.
The Grantors,their heirs and assigns,reserve the right to alter the course of the said fifty-
foot road or right-of-way between its present termini at their own expense,provided that said
relocation will follow a reasonably direct route between said termini,be of equal width,and of at
least equal quality. It is a consideration of the said appurtenant easement that the normal and
routine expenses of maintenance of the said roadway and easement,as distinct from the cost of
relocating the same,shall be divided from time to time between such parties as use the said road
in proportion to their then normal use of the same,with any party damaging the said road by
abnormal use being required to bear the full expense of remedying such damage.
There is also appurternant to the said conveyance an access easement as shown on the
plat attached to this deed running from the cul-de-sac to the western boundary of Lot B all as
more fully set forth in a Road Maintenance Agreement between the parties recorded immediately
following this deed.
The said property is conveyed subject to all easements,reservations,restrictions,
conditions,and other encumbrances contained in duly recorded deeds,plats,and other

instruments constituting constructive notice in the chain of title to the said property which have
not expired by a time limitation contained therein or otherwise have become ineffective.
