"Property"), Owner — Old Trail Heights LLC, 400 Locust Ave #3, Charlottesville, VA 22902
Mr. Reid Murphy:
In response to your request for a Letter of Zoning Compliance for the above referenced
Property, please be advised of the following:
1. The Property is zoned Neighborhood Model District (NMD) per Zoning Map Amendment
ZMA200400024, approved September 14, 2005, with proffers. The Property is also
subject to the Entrance Corridor Overlay District as described in Section 30 of the
Zoning Ordinance.
2. The Property is subject to the use provisions outlined in the code of development
established with ZMA200400024, approved September 14, 2005, with proffers.
3. The Property is located in the zone CT5 Block 3, according to and defined by the code of
development. The allowable uses of the property and density restrictions are outlined in
the code of development on pages 25-27. The proposed conversion of the residential
space into an office space does not appear to violate any of the provisions in the code. A
copy of the code of development and the applicable proffers can be accessed online and
are linked below.
4. The Property is subject to Side Development Plan SDP201500030, approved July 27,
2015. The Property is still under construction as of the date of this letter, but it appears
the site is being constructed in accordance with this plan.
5. The proposed conversion of a two bedroom residential unit into office space will not
create any parking issues on the site. The shared parking agreement approved on
December 27, 2011 is still valid.
6. There are no known violations of the zoning ordinance on the Property.
7. Copies of any applicable records may be obtained via the noted links or from this office
with a request through the department's Records Manager, Paul Bjornsen, at
pbjornsen(cDalbemarle.org once they have been approved or issued.
