HomeMy WebLinkAboutSDP201800027 Resolution - Board of Supervisors 2018-09-05RESOLUTION TO APPROVE SPECIAL EXCEPTION FOR SDP201800027 — VERIZON — FRYS SPRING TIER II (5TH STREET STATION) WHEREAS, the Owner of Tax Map Parcel 076M 1 -00-00-00200 filed an application for a Tier II Personal Wireless Service Facility, and the application is identified as Site Development Plan 201800027 (SDP 18-27); and WHEREAS, SDP 18-27 included a request for a special exception to modify the requirements of County Code § 18-5.1.40(b)(2)(c); and WHEREAS, Albemarle County Code § 18-5.1.40(b)(2)(c) requires that antennas be mounted so that in no case shall the closest point of the back of the antenna be more than twelve (12) inches from the facility, which may be modified by special exception. NOW, THEREFORE, BE IT RESOLVED that, upon consideration of the foregoing, the staff report prepared in conjunction with the application, all of the factors relevant to the special exception in County Code §§ 18-5.1.40(b)(2)(c), 18-33.5, and 18-33.9, and the information provided at the Board of Supervisors meeting, the Albemarle County Board of Supervisors hereby approves the special exception to modify the requirements of County Code 18-5.1.40.(b)(2)(c), subject to the condition attached hereto.
