Charlottesville, VA 22901, currently titled in the names of Robert H. Rosenthal,
Harrison Nesbit I1 and Henry J. Price, former Co -Trustees (with current Co -
Trustees being Sandra P. Amato (formerly Creech), Christopher B. Gleason and
Hunter W. Wood) of the Henry James Price Irrevocable Trust u/a dated December
1, 1982 (the "Property")
Dear Ally Bank:
In response to the recent request for a letter of compliance with zoning requirements regarding
the above -referenced Property, please be advised of the following:
The Property is situated on a parcel of land lying in the County of Albemarle,
Virginia, consisting of 10.00 acres of land, more or less, and improvements, as
more particularly shown as Parcel B on a plat of William S. Roudabush, Jr., Inc.,
dated October 20, 1977.
2. The Property is zoned Highway Commercial (HQ on the County's official zoning
map and code, and all regulations promulgated thereunder (collectively, the
"Zoning Code") and, thus, is consistent with the current uses for the Property,
which are the sales, financing and service of new and used motor vehicles (the
"Current Uses"). As of the date of this letter, the Current Uses are among the uses
permitted by right within the Highway Commercial (HQ zoning designation.
3. The Property and Current Uses do not violate any existing Zoning Code in effect
on the date hereof.
4. All requirements of the Zoning Code related to ingress and egress from the
Property to a public street have been satisfied. The Property enjoys access onto
Seminole Trail (U.S. Route 29).
5. The County has not approved any applications for rezoning of the Property, nor
any special permits, conditional use permits or variance requests in connection
with this Property, and no such applications or requests are currently pending.

6. There are no proffered conditions applicable to or enforceable against the
Property that would prevent use of the Property for the Current Uses.
7. There are no special conditions or time constraints applicable to or imposed on
the Property for the Current Uses.
8. There are no proceedings, pending or threatened, to revoke, rescind, alter, or
declare invalid any laws, ordinances, codes, approvals, permits or certificates
applicable to or issued in connection with the Property by the County of
Albemarle, Virginia.
9. There are not any outstanding parking, zoning or code enforcement issues
affecting the Property, nor any such matters previously affecting the Property.
