Charlottesville, VA 22903 www.timmons.com March 8, 2018 County of Albemarle Bill Fritz, AICP—Chief of Special Project Department of Community Development 401 McIntire Road Charlottesville, VA 22902 RE: Woolen Mills Redevelopment—Waiver Request from Section 4.12.15(g) Dear Mr. Fritz: With this letter and attached exhibit, we would like to formally request a waiver to provide curb& curb/gutter in all parking areas and along travelways as described in Section 4.12.15(g)of the Albemarle County Code. The area in question is the portion of drive aisle and 20 proposed parking spaces located directly behind the existing buildings, between the proposed rain garden and existing floodwall. This area can be found on the Initial Site Plan Submission. The site currently consists of an asphalt road that travels the entire length of the building and behind the floodwall. Stormwater runoff sheet flows through the existing vegetation and into Moores Creek. In order to maintain the existing sheet flow drainage pattern, the proposed design does not call for curb &gutter. Please note VDOT standard guard rail is provided along the southern side of the parking area. Providing curb and gutter along this area of parking is not necessary to convey stormwater to meet quantity requirements. There is currently 0.34 acres of impervious area draining directly to Moores Creek. In the proposed condition the amount of impervious area sheet flowing across the pavement to Moores Creek has decreased to 0.29 acres. This decrease in impervious area will not create any additional erosion issues along this portion of the property. We appreciate your considerations for the proposed exception request. The travelway in question directly connects to East Market Street on the northeast side of the property. This area can be found on Sheet C4.3 of the Initial Site Plan Submission. The location of this entrance to the property utilizes an existing paved road to access the eastern side of the Woolen Mill facility. This driveway is considered as a secondary point of access to the property as it leads to only 28 parking spaces.The main entrance to the property is located off Broad Street and the remaining 297 parking spaces. The anticipated number of vehicles using the access road from East Market Street is significantly less than the other entrance to the property.The following site conditions hinder the access road from being improved to meet requirements in Section 4.12.17(c)1: 1. The existing driveway that connects to East Market Street is also located within a floodway and 100-year floodplain. Development within the floodway and floodplain is extremely limited to mill and overlay of existing asphalt pavement without providing extensive flood plain analysis and obtaining FEMA permits. 2. The existing driveway is constrained by the existing residential structure to the west of the proposed connection. The existing drive narrows down to 12 feet in width at the smallest point at this location. Any road widening would be required to take place on the eastern side of the drive and would require a retaining wall along the edge to bring the road up to grade, disturbing steep slopes, and placing fill within the flood plain. 3. The portion of the property on the eastern side of the existing access driveway is bound by managed slopes which provide additional limitations on retaining wall heights that would be required as part of a driveway expansion. We have proposed to mill and overlay the existing asphalt pavement to improve road surface conditions. This approach will create minimal disturbance within the floodway and flood plain. Please refer to attached exhibit for additional information. We appreciate your considerations for the proposed exception request.
