The County of Albemarle Planning Division will grant or recommend approval of the family division referenced
above once the following comments have been addressed: [Each comment is preceded by the applicable reference,
which is to the Subdivision/Zoning Ordinances unless otherwise specified.]
[18 See. 4.2.1 (a) and 4.2.2 (a)] Building Site. Regarding Note 9, Albemarle County's Code requires new
parcels provide and ensure a minimum building site area of 30,000 square feet or greater. Provided in the
code are restrictions around what can/cannot count towards the 30,000 square feet. For example, the site
must be composed of a contiguous, rectangular land area that is not within critical slope areas, the flood
hazard overlay district, etc. I have concerns about the ability of the proposed parcel to meet these
requirements. Please review the referenced code sections (also attached) and submit an exhibit sheet to
ensure and demonstrate that these requirements are being met.
2. [14-203, 14-308.1, 17-10021 Tier 2 Groundwater Assessment. All plats showing lots less than 21 acres
require this assessment to be completed. Please submit the required $355 fee and staff will complete the
assessment.
[14-212] Affidavit. Please submit a completed affidavit verifying the family relationship of the grantor and
grantee (attached).
4. [14-212(B)] Family subdivisions; conditions of approval. The subdivider shall place a restrictive covenant
on the lots created by the family subdivision. A template for this covenant is attached. Please submit a draft
of the restrictive covenant to me and I will review it and forward it to the County Attorney for his
review/approval.
5. [14-302 (A)(10)] Right of further division of proposed lots. Based on the history and size of the original
parcel, there are only four development rights associated with this property. Development rights, unless
there have been other subdivisions associated with the property, are calculated as one development right per
every two full acres, up to a maximum of five development rights per parcel. As such, please revise Note 7
to account for four development rights instead of five. Keep in mind that any new parcel must be assigned
at least one development right.
6. [14-302(B)7] Reservoir watershed. Please revise the watershed note as follows: "This property lies in the
South Fork Hardware River Watershed which is not a Water Supply Watershed and does not lie within an
agricultural or forestal district ".
7. [14-303 (C)] Boundary Lines. Please provide, as a note or label, the horizontal perimeter distances between
the northwest corner of TMP 99-92 and SPC 1 and SPC4.
8. [14-303 (S)] Control Points. The County Code requires at least four control points, evenly distributed across
the property and located at survey property corners. While the submitted plat provides four control points,
their distribution across the parcels is not even. To satisfy this requirement, please provide an additional
control point at the northwestern corner of TMP 99-92 between the existing SPC 1 and SPC 4 control points.
9. [14-303 (1)] Monuments. Please label and/or include in the legend Iron Set (IS) symbols used on the plat
map.
10. [14-302 (B)(1)] General Information. When submitting the revised plat, please include a date of last revision
on each sheet.
11. [14-309 & 14-3101 Soil evaluations & Health Director approval ofseptic systems. For a family subdivision,
any proposed lot which is less than 5 acres in size shall be approved by the Health Director. Prior to final
plat approval the Health Director shall approve Parcel X as containing both a primary and reserve drainfield.
If this lot only contains a primary drainfield, soil work will be needed to locate the reserve drainfield.
