Relief is sought from the critical slope requirements of Section 18-4.2 of the Albemarle County Zoning Ordinance, to facilitate the grading and construction improvements associated with the proposed development. This request accompanies the set of plans, which depicts the critical slope locations within the subject parcels TMP 08900-00-00-073G5 and TMP 08900-00-00-073G6. As shown within the application plan, there are areas with 25% or greater slopes that are proposed to be disturbed as part of this project. The following summarizes the critical slope characteristics of the subject parcel & proposed impacts Total Project Area: 45.326 acres Existing Critical Slopes: Natural: 22.17 ac. Manmade: 0.00 ac. Total Project Area Critical Slopes: 22.17 acres Impacted Critical Slopes Impacts to Natural Critical slopes: 0.20 ac. Impacts to Manmade Critical slopes: 0.00 ac. Total Project Area Critical Slope Impacts: 0.20 acres Percentage of existing natural critical slopes impacted: 0.9% Percentage of existing manmade critical slopes impacted: 0% Percentage of Total Project Area Critical Slopes Impacted: 0.9% The total area of critical slopes disturbed by the proposed development is 0.20acres, which comprises 0.90% of the 22.17 total acres of critical slopes that exist on the property. In general, few areas of critical slope on this site are proposed to be WNW impacted. It is also important to note that these critical slopes are not part of a larger system. Given the minimal impact to critical slopes on this site; we respectfully request that this waiver be reviewed and approved by staff. Development of this site would be unreasonably restricted by the requirements of Section 18-4.2 of the Ordinance. Below, the considerations of developing critical slopes as provided in the Zoning Ordinance Section 18-4.2 are addressed: 1. "movement of soil and rock": Critical slopes only cover 2% of this site. Erosion and sediment control measures will be implemented to ensure that no construction runoff harms adjacent areas. 2. "excessive storm water runoff": Disturbance of this very minimal portion of critical slopes should not have any negative impact on the stormwater system for this site. 3. "siltation of natural and man-made bodies of water": Most of the natural drainage area is being preserved. The erosion and sediment control plan for this project will take measures to ensure that stormwater runoff is captured and treated before reaching natural and man-made bodies of water. These measures will be inspected and bonded by the County to ensure their proper functioning and continued stability. 4. "loss of aesthetic resource": There is no loss of aesthetic resources. The intermittent stream area on this site will be maintained as open space for the project. 5. "septic effluent": The proposed plan does not impact septic areas and therefore will not release any septic effluent to the surrounding environment. The evidence provided herein demonstrates that the grading within critical slopes on this project will not have any negative impact to public health, safety, welfare, or other considerations that might result from the disturbance of the critical slopes.
