Attached is a sample of such a recorded Supplement(#5). These supplements are provided for in the recorded CC&R's and it draws each of the newest Plats in under the purview of the original CC&R's that the County reviewed and approved years ago as part of the subdivision process. The original recorded CC&R's are attached too. The Open Spaces will not get deeded to the HOA until it is complete and ready to be deeded. To deed Open Space earlier would likely violate state law on the subject. The missing tree easement can be corrected by merely adding it to the new BLA Plat. If this particular Plat in question is next, it will be recorded with Supplement#6 that essentially looks similar to Supplement#5. That very likely will be a supplemental agreement, or something similar. We have legal proof of who will own and maintain them before we can approve it. Therefore,you will also have to submit to me any existing/recorded legal documents that you they will be "supplemental" to. You will also need to fill out the maintenance checklist, and highlight the sections of the supplemental agreement and the existing/recorded document to show that all maintenance requirements that the County Attorney's office will be looking for are handled in the combined documents. So, maybe not a "deed" so to speak, but legal documents and County Attorney's office review are both required. That is why it is a more higher review/submittal fee. She would record the BLA with a declaration to the CC&R's and that's all that is needed. So it sounds like the fee and application that we have in place is all we need. This easement is associated with a site plan and is shown on the approved site plan, but it was missed on the recorded plat so were cleaning it up by showing it on this one. Although it has boundary line adjustments in it also has the creation of a special lot and an easement. Both the special lot and easement creation will also require submission of legal document, existing and proposed. So, please let me know if you want to officially withdraw it and then resubmit correctly. Then resubmit under the correct type of review. Of the three items you will be accomplishing with this plat,the Easement with a deed has the highest fee. So submit under that type of review. Once you have withdrawn the current submission, and resubmitted,you will need to officially request a refund for the BLA submission fee. In order to do so you need to contact Jen Smith (jsmith2@albemarle.org)to ask for the refund and to explain why a refund is required. It has a landscape easement. It has the creation of a brand new open space (adding a special lot). And it is a BLA. The landscape easement and the open space need to be brought into ownership and maintenance by the HOA of Cascadia. She would record the BLA with a declaration to the CC&R's and that's all that is needed. So it sounds like the fee and application that we have in place is all we need. Although it has boundary line adjustments in it also has the creation of a special lot and an easement. Both the special lot and easement creation will also require submission of legal document, existing and proposed. So, please let me know if you want to officially withdraw it and then resubmit correctly. Then resubmit under the correct type of review. 8 Of the three items you will be accorlishing with this plat,the Easement with a`Geed has the highest fee. So submit under that type of review. Once you have withdrawn the current submission, and resubmitted,you will need to officially request a refund for the BLA submission fee. In order to do so you need to contact Jen Smith (jsmith2@albemarle.org)to ask for the refund and to explain why a refund is required.
