Please be advised of the following for Tax Map 60, Parcel 68 (the "Property"): • The Property is zoned Rural Areas under the Zoning Ordinance of Albemarle County, Virginia (the "County"), and is located in the Entrance Corridor Overlay District (EC), and the Steep Slopes Overlay District. • The Property is subject to Special Use Permit SP201500024 for establishment of a private school named The Field School of Charlottesville. • The approval of SP201500024 required development to be in general accord with sheet four (4) of the concept plan titled "Special Use Concept Plan and Exhibits for Field School of Charlottesville" prepared by Shimp Engineering, P.C., revision #5, dated October 27, 2016. • Special Use Permit Condition #1 of SP201500024 allows for "minor modifications to the plan" which are in general accord with the listed major elements and minimize or improve impacts on adjoining properties or roadways. • The exhibit titled "Minor Modification of Special Use Concept Plan for Field School of Charlottesville," prepared by Shimp Engineering, P.C., revision #1, dated October 1, 2018, shows minor modifications to the concept plan referenced in Condition #1 of SP201500024. These modifications consist of an adjusted alignment of the eastern boundary line to facilitate convenient access to the neighbor's adjoining property, Tax Map 60, Parcel 68B. The following major elements are listed in the special use permit conditions: • Locations of buildings and sports fields within the indicated envelopes • Maximum total building footprint of thirty thousand (30,000) square feet December 28, 2018 LOD-2018-00022 Page 2 of 2 • Maximum footprint of twelve thousand (12,000) square feet for any single building • Preservation and installation of tree buffers as indicated • Preservation of wooded areas and slopes outside the building and sports field envelopes as indicated. The adjustment of the eastern boundary line retains a ten (10) foot landscape buffer at the landscape buffer's easternmost boundary, and maintains the twenty-five (25) foot preserved tree buffer "C" with no overall loss of preserved tree buffer. This maintains the requirements of the major elements listed. Additionally, these modifications are requested to improve impacts on an adjoining property. No other major elements are impacted by these modifications. It the County Attorney's advisory opinion and my official determination that the minor modifications contained in the above referenced exhibit dated October 1, 2018 are in accord with major elements and minimize impacts on adjoining properties. No amendment of special use permit SP201500024 is necessary for the changes described above. If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this determination shall be final and unappealable. An appeal may be taken only by filing an appeal application with the Zoning Administrator and the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a fee of $258 plus the actual cost of advertising the appeal for public hearing. Applications for Appeal of the Zoning Administrator's Determination are available at the Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia 22902 or online at www.albemarle.org/cdapps. This form applies to the appeal of a decision of the zoning administrator or any other administrative officer pertaining to the Zoning Ordinance.
