Sue,
If you would like to get a refund, you will need to let me know today. Otherwise, I will be denying the plat
when I return to the office and you will just need to resubmit a plat that meets the requirements of the
ordinance and fee, if that is the route you would like to take, when you are ready.

Thank you for the clarification.
I am weighing the options. How much time do I have before the current application must be pulled?

Hello Megan,
I appreciate hearing back from you. I would like to know how the written instrument is prepared for pursuing the
vacation process?
Please let me know.
Thanks

Sue,
See below from Bill on your options for what you are trying to achieve. Please let me know which route
you would like to take. If you wish to go the vacation route, please let me know that you would like to
withdraw your boundary line adjustment application and I will get your fee refunded.

I have taken a look at this. The vacation option applies to any recorded plat. It doesn't have to be one approved by
the County. This makes two options available to achieve the result desired by the applicant.

Submit a boundary line amendment plat meeting all of the requirements of the ordinance. Or
Process a vacation as permitted under 14-212.2(B) of the Code of Albemarle and §15.2-2272(1) of the Code
of Virginia.
https://law.Iis.virginia.gov/vacode/titlel5.2/chapter22/section 15.2-2272/
The vacation process involves a written instrument signed by all of the owners of the lots (even if she is the owner
of all the lots) The fee is $258. It is an administrative process.

Hello Megan,
This application represents a unique case because these two parcels are necessary to make a whole that meets
Albemarle County's subdivision ordinance when a Farm is subdivided. They were only allowed to be separated due
to VDOT taking the smaller parcel under eminent domain for the route 10 bypass project which became defunct
in 2014. 1 am simply asking to have the property restored to one legal parcel.
The documents provided are the same ones used in the County's determination of no subdivision rights being
available on the smaller parcel.
There have been no changes to the parcels they should require spending more time and dollars on surveying and
engineering fees for new redundant documents for simply restoring the property to the acreage for which the
county previously approved when the farm was subdivided to create Roslyn Heights Subdivision.
I would like immediate consideration to be given to these circumstances.
Thanks
Sue

Good Afternoon,
We received the above application, however there was not a plat submitted for review, therefore we
cannot accept this application. A plat that meets all the requirements of a boundary line adjustment by a
professional engineer or surveyor is required.
You can either withdraw the application or we will take an action for denial. Please let me know how you
wish to proceed.
