THIS DEED OF CORRECTION made this 256 day of July, 2014, by and between
BESSEMER TRUST COMPANY, N.A., Trustee of the Eleanor Cameron Peterson
Testamentary Trust established under the Last Will and Testament of Eleanor Cameron
Peterson, deceased, Grantor, and RURAL PRESERVATION TRACT, LLC, a Virginia
limited liability company, whose address is 1444 Dry Pond Highway, Stuart, Virginia 14171,
and ENERGY K, LLC, a Virginia limited Iiability company, whose address is 11275
Highway 98, Suite 6, Box 350, Miramar Beach, FL 32550, Grantees;
WITNESSETH:
WHEREAS, by deed dated February 26, 1952, of record in the Clerk's Office of the Circuit
Court of Albemarle County, Virginia, in Deed Book 300, page 102, John S. Wise and Elizabeth
Thompson Wise, his wife, conveyed a parcel of land in said County on Newcomb's Mountain,
about five miles west of Charlottesville, containing 125 acres, more or less, to Eleanor C. Van
Clief, later and also known as Eleanor C. Peterson and Eleanor Cameron Peterson; and
WHEREAS, said parcel was subsequently conveyed by Eleanor C. Van Clief by deed
dated July 1, 1965, of record in the Clerk's Office of the Circuit Court of Albemarle County,
Virginia, in Deed Book 409, page 119, to Gloria A. Bennett, in which deed EIeanor C. Van Clief
recites that she thereby conveyed "the same land in all respects" that had been previously
conveyed to her by the aforementioned deed; and
WHEREAS, said parcel was subsequently conveyed to Rural Preservation Tract, LLC, and
to Energy K, LLC; and

WHEREAS, the differences in surveys of record in said Clerk's Office in Deed Book 70,
page 218; Deed Book 195, page 245; Deed Book 195, page 246; Deed Book 409, page 121; Deed
Book 1656, page 210 and Deed Book 2438, page 465, have raised questions as to whether Parcel
X, containing 8.28 acres, as shown on the attached plat of Brian S. Ray, Land Surveyor, dated
April 7, 2014, made a part hereof, was included in the transfers to the Grantees even though there
is no evidence of record indicating that Eleanor C. Van Clief or any of her successors in title ever
intended to retain said Parcel X, and, in fact, evidence of record is to the contrary; and
WHEREAS, the said Parcel X does not have a tax map parcel number and is assessed in
part to Rural Preservation Tract, LLC, and in part to Energy K, LLC; and
WHEREAS, Eleanor Cameron Peterson died testate on September 5, 1987, and by her Last
Will and Testament dated January 23, 1987, probated on November 23, 1987, and spread in said
Clerk's Office in Will Book 66, page 400, she devised her residuary estate to Faith Van Clief
Meredith, Trustee, and E. Norman Peterson, Jr., Independent Trustee, of the Eleanor Cameron
Peterson Testamentary Trust established under said Will (the "Eleanor Cameron Peterson
Testamentary Trust'); and
WHEREAS, Bessemer Trust Company, N.A., is the currently serving Sole Trustee of the
Eleanor Cameron Peterson Testamentary Trust; and
WHEREAS, Bessemer Trust Company, N.A., Trustee of the Eleanor Cameron Peterson
Testamentary Trust, desires to confirm that the said Parcel X was conveyed to Gloria A. Bennett,
such that said Parcel X was thereafter conveyed to the current successor in interest of Gloria A.
Bennett, namely Rural Preservation Tract, LLC, and Energy K, LLC, in the same manner as
assessed by the County of Albemarle, Virginia, and as shown by it on Tax Map 74.
NOW, THEREFORE, in consideration of the premises, Bessemer Trust Company, N.A.,

Trustee of the Eleanor Cameron Peterson Testamentary Trust, hereby QUITCLAIMS and
CONVEYS unto Rural Preservation Tract, LLC, and Energy K, LLC, all of their right, title and
interest in the above described Parcel X.
Parcel X is not to become a separate lot nor to be owned jointly by the Grantees, but is to
be held by the Grantees as parts of TMP 07400-00-00-00180 and TMP 07400-00-00-001 SC,
respectively.
The property hereby conveyed is subject to any and all easements, restrictions, reservations
and conditions contained in duly recorded deeds, plats and other instruments constituting
constructive notice in the chain of title to the above described property, which have not expired by
a time limitation contained therein or have not otherwise become ineffective, and to any Iien
inchoate or otherwise, for real estate taxes or assessments, not yet due and payable.
