SUB-2018-160 Caliber Collision — Easement Plat
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
1. [COMMENT] Please note that the planning review comments are based upon the plat
that was submitted to planning on 10/29/18, prior to the 1st submission comments from
most of the reviewers including planning. Please see comment #15 below for more
information.
Rev. 1: Comment no longer needed.
[14-301 (B)] Scale. Revise the plat sheets to all to have a precise scale and have the
scale correctly specified both in the title block and with the correct scale bar. All of the
plat sheet scales do not appear to be correct. All are labeled as 50 Scale, both in the title
block and by the scale bar. However, most appear to actually be 40 scale, and appear to
be accurate at that scale. However some of the sheets also do not appear to be any
specific scale.

3. [14-301 (D)] North Arrow. Revise sheets 2 through 7 to have a north arrow in the main
area of the plat. The north arrow in the vicinity only applies to the vicinity map.

4. [14-302 (A)(1)] Name of subdivision. Include in the title on the coversheet that it is for
Caliber Collision and the tax map parcel numbers of the two parcels.

[14-302 (A)(4) & (6)] Private Easements; Alleys and shared driveways. Address the
following:
a) Show all existing easements, including the shared driveway easement, on sheets 2
through 7.
Rev. 1: Comment addressed.
b) Ensure all existing easements, and the labels for those easements, are represented
with thinner or lighter line work and text than the proposed easements.
Rev. 1: Comment addressed.
c) Label all existing easements as "EXISTING', and all proposed easements as "NEW",
by including that in their labels.
Rev. 1: Comment addressed.
d) Provide the required documentation to support and create all easements. All deeds
that are required for the easements and maintenance must be submitted, reviewed
by the County Attorney's office and recorded with this plat.
Rev. 1: Comment not yet fully addressed. Address the following:
L ALL legal documents that include a reference to this plat must
have the description of the plat updated with the final revision date
prior to signatures and recordation.
ii. The ACSA deed of easement must be provided to ACSA, reviewed
by ACSA and approved by ACSA. Work with ACSA directly as
mentioned in an email to the project contact in a previous email.
iii. There are no comments on the "Deed of Stormwater Drainage
Easement".
iv. Either the FULL plat must be recorded WITH the deed or it must be
recorded prior to the deeds and have the plats deed book and
page number referenced in the deed.
a. If the plat is being recorded WITH a deed then the full approved
(signed/notarized & signed by the County) plat must be
included when recorded with the plat. Individual exhibits from
the plat are not sufficient in this case.
b. If the (signed/notarized & signed by the County) plat is
recorded PRIOR TO a deed then the deed book and page
number for the previously recorded plat must be included in
the legal document that is referencing it. IN THAT CASE
individual pages of the previously recorded deed can also be
included as individual page "exhibits" instead of the whole
plat.
c. Since multiple deeds are to be recorded one of the deeds will
be recorded with the full plat and the other deeds will be
referencing the previously recorded plat.
v. In the "Deed of Access Easement and Abandonment", on page 1 at
the bottom, the PROPOSED access easement is referred to
"Exhibit C" when it is actually "Exhibit D".
vi. In the "Deed of Access Easement and Abandonment", on the sheet
prior to "Exhibit E" it specifies that it is the "Shared Driveway
Easement" when it should state that it is the "Construction and
Grading Easement".
vii. "Exhibit F" for the "Deed of Access Easement and Abandonment"
does not appear to be correct. Address the following:
a. This exhibit is not one of the sheets from a plat currently
under review by the Countv.
b. On the sheet prior to the exhibit it is labeled as a "potential"
drainage easement. No road drainage easement is proposed
on any of the plats under review with the County at this time.
The easement shown also appears to be within the area of
road dedication for public use shown on SUB2018-198. Since
this area of the parcel is being dedicated to public use the
road drainage easement would not be required since VDOT
would have full rights to the area.
c. It appears to be showing a road right of way dedication for
public use. However, what is shown does not match the road
dedication for public use shown on the special lot plat
(SUB2018-198) under review with the County at this time.
d. It does not appear that "Exhibit F" is referenced in the
document. Please explain why it is an exhibit if not referenced
in the document — or if in the document what part of the
document is it referenced?
[14-302 (A)(5) & 14-303 (L)] Public Easements; Public utility, drainage and sight
distance easements. Address the following:
a) Ensure all existing easements, and the labels for those easements, are represented
with thinner or lighter line work and text than the proposed easements.
Rev. 1: Comment addressed.
b) Label all existing easements as "EXISTING", and all proposed easements as "NEW",
by including that in their labels.
Rev. 1: Comment addressed.
c) Provide the required documentation to support and create all easements. All deeds
that are required for the easements and maintenance must be submitted, reviewed
by the County Attorney's office and recorded with this plat.
Rev. 1: Comment not yet fully addressed. See comments for 5. d)
above. Those comments apply to both private and public
easements. Address the comments. Provide full addresses.
d) See the attached email from John Anderson, previously sent to you, in reference to
the process for the Stormwater Management deed and maintenance process.
Ensure this process is followed and completed.
Rev. 1: Comment not vet fully addressed. See the email from
12/21/18 in reference to these two legal documents. Also, ensure
that prior to signing the documents they have been updated for
the final revision date of the plat once it is approved.
[14-302 (A)(14) & 14-314] Land to be dedicated in fee or reserved; Identification of all
interest of the County in the property. Address the following:
a) Revise the coversheet to include a note specifying SP2017-16 condition of approval
#3. The note should state, "As specified in condition #3 of SP 2017-16, `Upon request
of the County, the applicant shall dedicate land within the 100-year floodplain and
stream buffers to public use near Moore's Creek for a potential future greenway trail.
Actual trail planning, permitting, and construction is to be carried out by others.' "
Rev. 1: Comment addressed.
b) Revise the label for the road right of way dedication to specify "To be Dedication to
County for Public Use in separate plat".
Rev. 1: Comment sufficiently addressed.
[14-302 (A)(15) & 14-303 (0)] Identification of all owners and certain interest holders;
Signature Panels. Address the following:
a) This easement plat creates plats on two different parcels and those parcels are owned
by different people/entities. Therefore owners of both parcels must sign the plat. Add
another signature area for the second owner, unless ownership will change prior to
approval by the County.
Rev. 1: Comment addressed.
b) The owner specified on the plats cover sheet, in the signature area, is not the owner
shown for either of the parcels in the other sheets of the plat or the owners shown in
the County's GIS. Ensure that the ownership of the parcels, and who is signing as the
owners of the parcel, is correct for both parcels.
Rev. 1: Comment addressed.
c) If the ownership of one or both of the parcels will change prior to approval by the County
recorded legal documents and/or plats will be required to be provided to shown the
new ownership prior plat approval by the County.
Rev. 1: Comment not vet fully addressed. This comment will remain
until the ownership at the time of the approval of the plat is solidified.
d) Revise the property owners name and address in all of the title blocks of the plat sheets
to be the owners for both parcels, not just one.
Rev. 1: Comment not vet fully addressed. The address is the address of
the owners and not of the parcel. Unless both owners live at that
address one address must be supplied for each owner.
[14-302 (113)(1)] General information. Add a revision date to the plat prior to the next
submission. No revision date was provided on the plat sent to the planning reviewer on
10/29.
Rev. 1: Comment not vet fully addressed. Address the following:
a) Add a new revision date for the next submission.
b) The revision date was not updated in this submission on sheets 4, 6 &
7. Ensure all sheets have the revision date updated.
10. [14-302 (113)(5)] Zoning classification. Address the following:
a) Include SP 2017-16 in the zoning area on the cover sheet and in each title block of the
sheets.
Rev. 1: Comment not vet fully addressed. "SP2017-16" should be listed
as part of the "Zoned:" information rather than above it. Move the text
to be included in the zoning information area.
b) Either revise the setback information so that what is in the cover sheet and what is
provided in the title blocks of all the sheets match or remove the setback information
from the plat.
Rev. 1: Comment not vet fully addressed. Revise, on all sheets, the
setback information for the "side and rear". What is listed is the
"minimum" and not the "maximum". Revise it to specify "Side and
Rear — Minimum:"
11. [14-302 (B)(10)] Stream buffers. Add the required stream buffer note. The note must
state, "The stream buffer shown hereon shall be managed in accordance with the
Albemarle County Water Protection Ordinance."
Rev. 1: Comment addressed.
12. [14-303 (A)] Statement of consent to division. Address the following:
a) Revise the first half of the wording of the consent statement to specify which parcels
are being impacted.
Rev. 1: Comment addressed.
b) Revise the first half of the wording of the consent statement to specify what is being
proposed with the easement plat. The statement currently state "property line
vacation" which is not what this plat is proposing.
Rev. 1: Comment sufficiently addressed.
c) If, as stated above, there are more than one owner for the two parcels then this
statement must be provided separately for each owner's signature area. Ensure in
doing so that the statements specifically state which parcel they are giving consent to
add the easements to, and it should only be the parcel they own.

13. [14-303 (0)] Notary Panels. Revise the cover sheet of the plat to ensure that there are
sufficient notary panels for the number of owners of the two parcels.

14. [14-312] Location of existing buildings. Revise the plat to show the location of the
existing building on TMP 77-11. One of the proposed easements appears to be in close
proximity of the building.
Rev. 1: Comment addressed.
15. [COMMENT] Prior to the first round comments being provided to the applicant another
submission was made of this plat. It is likely that only engineering comments had been
provided to you prior to this comment letter. Since this resubmission was made so recently
sufficient time was not available to distribute this "second submission" to the other
reviewers, without causing a delay in the review already underway, and therefore the
10/29/18 "submission" has been reviewed by planning only. IMPORTANT: ACSA and
VDOT comments were based on the 9/11/18 submission. The 10/22/18 Engineering
comments are based upon a PDF that was sent to engineering and to my knowledge no
other reviewer. Address all comments provided, from all reviewers, and then resubmit the
easement plat for review. With that resubmission all reviewers will receive the same
version of the plat at the same time.

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section has reviewed the Caliber Collision- Easement Plats, dated July 16, 2018, revised on
December 07, 2018 as submitted by Survey Matters, LLC, and find it to be generally acceptable.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the VDOT Charlottesville Residency Land Use Section at (434)
422-9399 for information pertaining to this process. If you have further questions, please contact
