Sorry to have taken a little more time on this, but the reworking of division rights needed some
additional review. Brian —thanks for the call a minutes ago. Looks like we need only some minor tweaks.
Private Street Agreement:
For Ms. Minter and Mr. Reback,
The updated agreement looks good. One thing: we need to make sure we have the latest date of the
plat. Currently, the agreement says, "dated May 24, 2017." The latest plat is dated June 26, but we need
to make a few more tweaks to the plat, so will need to be dated to the pending changes.

We just talked, but this is a follow up. In the June 26 version, you have two division rights in 69-50C1 and
two in 69-50C. You simplified the note, as asked - thanks. Please change the note further to say:
"Tax Map Parcel 69-50C1 retains three development rights and may be further divided. Tax Map Parcel
69-50C retains one development right, which must be within the area shown as parcel Z on the plat
recorded at D.B. 2634-244."
We wanted you to keep in mind'that with a division right on the new 69-50C, under this proposed
version, the applicant would need another two acres on that parcel to actually use it. The acreage would
need to be at least 23.03. They can come back at any time with a boundary line adjustment to take that
acreage from 50C1. That's a pretty simple thing to do.
Chris Perez can answer additional questions about the division rights, if you have questions. His
extension is x3443.
If you can make that change and get signatures in the morning, we can provide signatures in the
afternoon. if late in the afternoon, past 2pm, just make attention to Chris Perez.

First, I want to remind you that when we started this project I let you know that your timeline was quite possibly
unachievable.
That being said, I contacted JT at the county earlier this week to check in per your request(even though I do not
like to bother them as I know they are as overwhelmed with work as we are) as he has always been extremely
helpful to me. He was able to track down the planner (Will Cockrell) who was responsible for this plat and Will
sent me comments yesterday while I was out of town on a conference for work. I planned to revise/resend on
Monday and let you know that we had good news.
All of this being said, I think the county team has actually been fairly quick with this one and I do not think we
have anything to complain about. I wish you had contacted me prior to sending out this group email.

passive aggressive retaliation.
If we don't have that approval in the next day or so, the buyer will lose their mortgage rate lock,
the County may lose this physician to Nelson County and I may lose this deal.
Can you tell me why a boundary line adjustment submission takes more than 24 hours? Can
you tell me when the County will become helpful and responsive?
I'm not asking for excuses or explanations, I am asking for action.

Also, you need to have the conversation with the developer about the 21 acre parcel not truly being able to be
subdivided without 2 DRs. It is suggested that he bump up the acreage of 50C to 23.003 to assure the DR can be utilized
in the future.

Hope all is well.
1 submitted a BLA plat a few weeks ago and although I realize that you guys may not have even looked at it yet, my client
is pestering me to ask you guys if you may have an estimate on when we might see comments. Not sure if this one fell in
your area or not, but if not maybe you can point me towards who is working on it. I think there are going to be some
comments about the development rights notes and we are in a time crunch to get this one wrapped up. Any update you
could provide that l could pass on to our client would be greatly appreciated.
The Plat was for Belle Vista LLC and appears to be SUB201700084 if I am navigating county view correctly.
