Dear Mr. Wilkins:
The contents of this letter are in reference to your con-
ference with both the County Planning and Zoning Departments
concerning the status of the quarrying operations in Albemarle.
County.
A quarry operation or removal of natural products from the
ear.th are particularly vulnerable. By their very nature, they
commence on one spot and spread to other ground as the mineral,
rock, etc, is exhausted. The nature of the excavating busi-
ness contemplates the use of land as a whole, and not a use
limited to a portion of the land already excavated.
The following list of properties (map parcel) are active
or operative quarrying operations that would be under a non-
conforming status providing that documentation of such activ-
ity could be validated.

Any other property would be identified as undisturbed or
with option for mineral rights. There can be no activity on
these parcels so indicated without a rezoning of the property.
Structures so located.at the date of the 1980 ordinance would
be nonconforming. Any future.proposed structures to be located
on the properties would be subject to county review and approval
as to their use and location.

I would suggest that you contact the County Planning Depart-
ment to discuss the feasibility of changing the zoning from RA
(Rural Areas) to Natural Resource Extraction Overlay District.
Rural Area zoned property allows for only Exploratory Drilling
by special permit under Section 10.2.2.38.
I trust the information provided will be adequate for your
request. Please contact the Zoning Office if you have any ques-
tions or need additional information.

Dear Mr. Evans:
I would like to thank you for your letter of June 18, 1986 and for your
continued expert assistance to me regarding the Albemarle zoning laws and how
they impact the permitted lands I own in Albemarle County used in soapstone
processing.
In your letter you requested documentation of "active or operative quarry-
ing operations" on the following tracts:

I am enclosing as documentation, a notarized statement from Kenneth V.
Carroll stating that there has been no discontinuance of operations on the above
parcels. Mr. Carroll, as you probably know, is the premier authority in the area
on this soapstone operation. In addition, I am sending a notarized statement from
me reflecting Alberene Stone Company activity since 1976. I would think this
should be sufficient for your files.
Also for your files, I am sending you a copy of a letter from Mr. Russell B.
Otis, County Administrator for Nelson:County. Mr. Otis offered his and the
Nelson County Board of Supervisors' assistance in this endeavor. His letter states
principally the same as yours regarding current quarry operations. It would appear
that future expansion in Nelson County would follow similar guidelines as referenced
by you.
I would like to request that you please send a letter addressed to the New
Alberene Stone Company and myself, stating essentially what you have in your
letter of June 18, 1986, with the exception that evidence has been furnished you
regarding quarry operations on the above referenced parcels and that the referenced
parcels qualify under a non -conforming status.

We will, in the future, I am sure, be addressing the question of the
additional parcels on which I hold mineral rights and other owned property
but, I do not believe that is necessary at present.
Again, I wish to thank you for your assistance.
