John Anderson County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to act on any VSMP permit by issuing a project approval or denial. This project is eligible for approval pending purchase of 0.32 lb./yr. phosphorus nutrient credits. Prior review comments are addressed. A. Stormwater Pollution Prevention Plan (SWPPP) The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. General: Development proposes stormwater discharge release 55' from a well that is source of drinking water for county residents. Albemarle requests well testing with independent state -certified laboratory analysis for the following petroleum constituents: benzene, toluene, ethylbenzene, total xylenes, naphthalene, and MTBE to establish baseline values. (Ref. Virginia Department of Health guidance for private well water testing where circumstance specific to property indicates elevated cause for concern.) Please also ref. 21-Jun 2018, Initial Site Plan Engineering review comment #18.d. Note that 6/21/18 review comment (18.d.) made specific detailed design request, as condition of VSMP approval. Revise accordingly. Engineering accepts that 6/21 comment came after 6/20 submittal of the VSMP plan. This development poses more than insignificant potential adverse impact to groundwater quality, and Albemarle would be remiss not to establish baseline levels for petroleum constituents which may or may not be present within the existing well. Spills of petroleum product will occur, will route via storm collection and pass untreated through a detention system, to be released approximately 55' from an existing residential well. This distance must increase to at least 100'. Again, petroleum product handling and dispensing pose intrinsic risk to an existing well water supply for county residents. (Rev. 1) Addressed. Pollution Prevention Plan (PPP) The PPP content requirements can be found in County Code section 17-404. 1. See A /Sec. 6 comments, above. Revise Sec. 6 Exhibit, as needed. (Rev. 1) Not addressed. See comment Sec. A., item 4., above. (Rev. 2) Addressed. C. Erosion and Sediment Control Plan (ESCP) Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESCP. This plan is approved. 1. C3/C4: Show /label steep slopes. (Rev. 1) Addressed. 2. C3/C4: Provide additional contour labels. (Rev. 1) Addressed. 3. C5: Provide well protection, similar to tree protection. Provide visible barrier to help prevent damage to existing well during construction. (Rev. 1) Addressed. Applicant response: `Well protection will not be provided since the well is located within the 20' buffer not to be disturbed. We have, however, provided a safety fence to keep construction related disturbances out of this area.' Engineering commends this response. 4. C5: Request Site Plan and VSMP C5 provide 2.5" -3" high berm beneath /within outline of canopy (plan view) to isolate spills that occur during vehicle refueling, from storm runoff. It may benefit Applicant to consider reasonable means of limiting potential contamination of existing well located approximately 18' from face of proposed retaining wall. (Rev. 1) Addressed/comment withdrawn. Applicant provides a detailed rationale favoring withdrawal of request. Engineering accepts rationale. Comment withdrawn. 5. C-6: Revise incorrect sediment trap table, H value. (Rev. 1) Addressed. Please provide two (2) additional full-size print copies of the VSMP plan for approval, one (1) additional SWPPP at your convenience, to CDD front desk with cover stating, `Not for review, for stamped approval.' Process (outline /Narrative): 1. The following items are needed before the VSMP application can be approved: a. Execution and recording of stormwater management agreement. This can take up to a week to get recorded, pending no changes are made to the County template. b. Nutrient credits purchase and affidavit is provided, if nutrient credit purchase proposed. c. Execution and recording of stormwater management facilities easement plat and deed. Review of the plat can take up to 30 days, but we will do what we can to review quicker. Review can take longer if changes are made to the deed template. 2. Once VSMP is approved, the following items are required before a land disturbance permit can be issued: a. All bonds must be posted. Applicant must submit a bond estimate request form and fee. We will then calculate the bond amount. Owner will then work with Ana Kilmer, Management Analyst, to post the bond. b. DEQ permit fee must then be paid and proof of payment provided (if > 1.0 acre). c. Pre -construction application, fee and meeting request is then required. Engineering Review Comments Page 5 of 5 After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will need to be submitted along with court recording fees. After bonding and agreements are complete, county staff will need to enter project information in a DEQ database for state application processing yarea of disturbance is 1.0 acre, or more. DEQ will review the application information based on local VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid directly to the state. For fastest processing, this is done electronically with the emails provided on the application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the application, they will issue a permit coverage letter. This should be copied to the county. Easements must be recorded prior to VSMP approval. Proof of purchase of nutrient credits is required to receive a Grading Permit. After DEQ coverage is issued, via the coverage letter (project >1.0 Ac), the County can hold a pre -construction conference. Applicants will need to complete the request for a pre -construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturber, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a joint VSMP (not required for this project) and grading permit will be issued by the County so that work may begin.
