Perez, Senior Planner Division: Planning Date: January 16, 2019 Subiect: SUB201800199 Wintergreen Farm - Easement Plat The County of Albemarle Planning Division will grant or recommend approval of the Easement Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] 1. [14-303(A)] The statement of consent to division references a boundary line adjustment taking place; however, it is unclear what part of the plat this references to. Additionally, the application was for an easement plat, as the title states. Please explain where the BLA is taking place. 2. [14-312] On the plat depict the location of the existing building on Lot 40. 3. [14-317] With the revised easement plat submit the required deed for the County to review and approval. The applicant is required to maintain the path; however, there shall be a public access easement over the path. The County is not responsible to maintain the path. This deed shall reflect this. Staff has provided references to provisions of Chapter 14 of the Code of the County of Albemarle. The Code is kept up to date by the County Attorney's office. The Code may found on the County Attorney's website which may be found under "Departments and Services" at Albemarle.org. In accord with the provisions of Section 14-229(B) of Chapter 14 of the Code if the developer fails to submit a revised final plat to address all of the requirements within six (6) months after the date of this letter the application shall be deemed to have been voluntarily withdrawn by the developer.
