You have asked for a letter that provides an analysis of the zoning and other information
regarding the referenced property. This letter is based on a review of our records and an
inspection of the site.
1. The referenced property is zoned Highway Commercial, HC.
2. The property is in the Airport Protection Area Overlay District- AIA.
3. There are no legal nonconforming issues associated with this site.
4. The Board of Supervisors, on March 17, 2004, approved Special Use Permit 03-77 with
conditions. The special permit allowed for off site parking on parcel 045C0-02-00-
001130. A copy of the action letter is enclosed.
5. The site development plan, SDP 03-83 was signed on 08/23/04 and shows both the
expansion of the parking and building addition.
6. This site is currently under construction with building permit (B200405756NC). The site
must be developed in accord with the approved site plan (SDP 03-83) and special use
permit (SP 03-77). If the site is developed in accord with the plan a Certificate of
Occupancy will be granted and the site to be found in compliance.

7. A review of our records does not show any unresolved zoning or building code violations
and /or complaints.
8. This zoning designation allows the subject property to be utilized for a design/idea
showroom for the sales, selection and display of plumbing, lighting, appliances, cabinets,
countertops, floor coverings, windows, doors and similar home products and fixtures. Be
aware this site is limited on parking and that retail requires 1 space per 100 S.F. The
majority of the parking for this site is calculated under large appliance sales @ 1 space
per 400 S.F. A copy of the parking schedule from the site plan is enclosed.

RE: SP-03-77 Ron Martin Appliances Parking Lot Expansion (Sign #36); Tax Map 45C, Parcel 02-1B
Dear Mr. Gloeckner:
The Albemarle County Board of Supervisors, at its meeting on, March 17, 2004, by a vote of 6:0, approved the
above -noted request. Please note that this approval is subject to the following conditions:
The facility shall be designed constructed and maintained as follows:
1. A final site plan shall be submitted for approval, which shall be in general accord with the revised plan that
shows improvements on Tax Map 45C Parcel 02-1 B, dated January 28, 2004;
2. At least one (1) sign shall be posted in the parking area that identifies the use as parking for the adjacent
commercial use only (Tax Map 45C Parcel 02-1A & 02-1), with size and location of the sign to be
determined and approved by staff;
3. The parking area shall be used for customer parking only, which shall be stated on the sign per condition
#2. Delivery and other commercial vehicles shall not be parked or stored in the parking area for loading,
unloading or any other purpose;
4. Additional landscaping shall be installed and maintained within the twenty (20') foot buffer, as necessary to
provide screening to complete a double staggared row of evergreen trees along the east side of the
property; and
5. A second 10'x10' concrete dumpster pad shall be constructed adjacent to the 10'x10' concrete dumpster
pad area shown on the plan dated January 28, 2004. The resulting 10'x20' dumpster area shall be
screened with a three (3) sided opaque fence and additional landscaping per the direction of staff.
In the event that the use, structure or activity for which this special use permit is issued shall not be commenced
within twenty-four (24) months after the issuance of such permit, the same shall be deemed abandoned and the
authority granted thereunder shall thereupon terminate. For purposes of this section, the term "commenced" shall
be construed to include the commencement of construction of any -structure necessary to the use of such permit
within two (2) years from the date of the issuance.
Before beginning this use, you must obtain a zoning clearance from the Zoning Department. Before the Zoning
Department will issue a clearance, you must comply with the conditions in this letter. For further information, please
call Jan Sprinkle at 296-5832.
