RE: Action Letter — Notice of Disapproval
(SUB-2017-00190 Harms Division Final Plat / TMP #21-40A1)
A review of the above -referenced plat (dated 12/4/2018) has been completed by Planning staff in
Albemarle County's Community Development Department (CDD). This review was completed using the
sections listed under Albemarle County Code Chapter 14 ("Subdivision Ordinance") Section § 14-207.
Pursuant to Subdivision Ordinance Sections § 14-207 and § 14-209, the application for the above -
referenced final plat is disapproved.
The proposed division of Tax Map Parcel (TMP) #21-40A1 into two parcels is not permissible (as shown
on the above -referenced plat, dated 12/4/2018). Proposed Lot 1 does not meet the applicable minimum
frontage requirements as specified in § 14-400 ("Minimum lot requirements.") and § 18-10.4 ("Rural Areas
District — Area and bulk regulations."), either by utilizing frontage with Preddy Creek Road or by utilizing
frontage on an authorized private street.
Additionally, no private street authorization request has been submitted pursuant to § 14-232, as would be
required in order to utilize a private street to comply with applicable minimum frontage requirements (and
as specified in prior review comment letters).
An updated review comment letter (dated 1/18/2019, regarding SUB-2017-00190 plat dated 12/4/2018) is
attached for your reference. Please also note that this decision may be appealed in accord with Albemarle
County Code § 14-231.
