A complication may be that the location shown for the project is the location approved by the historic preservation committee. The location was identified due to the fact its not visible from the main house, which is a historic structure. I don't know if this will have any impact to the decision, but may be a bit of added information. I have asked for input from zoning. So far I am hearing it isn't allowed since it requires a building permit, and anything that requires a building permit can't be located in the buffer if there is another location outside of the buffer/floodplain. I have a quick question regarding a small project we are building for a landowner in town that I was hoping you could answer. As the attached image shows it sits at the edge of the 100ft floodplain and thus within the WPO Buffer area. No grading or land disturbance will be required to construct the system other than driving piles and the total area of disturbance should be much less than the 10,000 sq-ft that would trigger the need for SWM and E&S plan submittal. My memory is a little hazy, but If I recall projects within the floodplain need to apply for a Floodplain development permit. Because of the nature of the project I wouldn't anticipate any impact to the floodplain, so would we simply need to submit a floodplain development permit application along with some sort of no -rise certification? Any advice would be greatly appreciated, I hope I'm not missing anything here?
