SUB-2018-160 Caliber Collision — Easement Plat
The County of Albemarle Planning Division will grant or recommend approval of the Final Plat
referenced above once the following comments have been addressed: [Each comment is
preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
[14-302 (A)(4) & (6)] Private Easements; Alleys and shared driveways. Address the
following:
d) Provide the required documentation to support and create all easements. All deeds
that are required for the easements and maintenance must be submitted, reviewed
by the County Attorney's office and recorded with this plat.
Rev. 1: Comment not yet fully addressed. Address the following:
i. ALL legal documents that include a reference to this plat must have the
description of the plat updated with the final revision date prior to signatures
and recordation.
Rev. 2: Comment not yet fully addressed. The Stormwater Facility and
Management Access easement, provided to you on 12/21/18 in an email
from Frank Pohl, also must have the revision date for the proposed plat
updated. Engineering will be providing you an updated version of this
document so that the revision date will be correct at recordation. PLEASE
NOTE that this is one of the documents that requires the County Executive's
signature. So, once the revision date is updated a signed and notarized original
must be provided with other deeds. Please keep in mind that since it will be
signed by the County Executive, and must be approved by the County Attorney's
office iust prior to that signature, the signing process is not immediate.
iii. There are no comments on the "Deed of Stormwater Drainage Easement".
Rev. 2: Comment not yet fully addressed. Submit a signed and notarized
COPY of this document once the plat revision date is finalized.
iv. Either the FULL plat must be recorded WITH the deed or it must be recorded
prior to the deeds and have the plats deed book and page number referenced
in the deed.
a. If the plat is being recorded WITH a deed then the full approved
(signed/notarized & signed by the County) plat must be included when
recorded with the plat. Individual exhibits from the plat are not sufficient in
this case.
Rev. 2: Comment addressed. It appears that the SWM Facility
Maintenance & Access Easement will be the deed in which the full
plat is attached and the other deeds will reference.
If the (signed/notarized & signed by the County) plat is recorded PRIOR
TO a deed then the deed book and page number for the previously
recorded plat must be included in the legal document that is referencing it.
IN THAT CASE individual pages of the previously recorded deed can also
be included as individual page "exhibits" instead of the whole plat.
Rev. 2: Comment not yet fully addressed. Since it appears that the
SWM Facility Maintenance & Access Easement will be the deed in
which the full plat is attached then the Deed of Access Easement and
Abandonment should be referencing the plat attached to that deed
and should include its Deed Book and page number. If this is the
case than revised the Deed of Access Easement and Abandonment to
have blanks for the deed book and Daae number so that information
can be written into the deed prior to recordation.
c. Since multiple deeds are to be recorded one of the deeds will be recorded
with the full plat and the other deeds will be referencing the previously
recorded plat.
Rev. 2: Comment not vet fully addressed. Address Rev. 2 comments
for "a." and "b." above.
vii. "Exhibit F" for the "Deed of Access Easement and Abandonment" does not
appear to be correct. Address the following:
a. This exhibit is not one of the sheets from a plat currently under review by
the County.
b. On the sheet prior to the exhibit it is labeled as a "potential" drainage
easement. No road drainage easement is proposed on any of the plats
under review with the County at this time. The easement shown also
appears to be within the area of road dedication for public use shown on
SUB2018-198. Since this area of the parcel is being dedicated to public
use the road drainage easement would not be required since VDOT
would have full rights to the area.
c. It appears to be showing a road right of way dedication for public use.
However, what is shown does not match the road dedication for public
use shown on the special lot plat (SUB2018-198) under review with the
County at this time.
d. It does not appear that "Exhibit F" is referenced in the document. Please
explain why it is an exhibit if not referenced in the document — or if in the
document what part of the document is it referenced?
Rev. 2: Comment not yet fully addressed. Although reference was
removed from the deed for Exhibit F, and the "potential" drainage
easement within the future VDOT right of way, it appears that too much
may have been taken out of the leaal document. On a Drevious
submission, in "Article I" there was a section with the heading of
"Temporary Construction Easement". Although it was referencing the
"potential" drainage easement in the future VDOT right of way (exhibit F)
it was ALSO referencing the "New Construction & Grading Easement"
that is still part of the deed. Please ensure that the information
previously in this section that pertains to the "New Construction &
Grading Easement" is covered within the document.
[14-302 (A)(5) & 14-303 (L)] Public Easements; Public utility, drainage and sight
distance easements. Address the following:
c) Provide the required documentation to support and create all easements. All deeds
that are required for the easements and maintenance must be submitted, reviewed
by the County Attorney's office and recorded with this plat.
Rev. 1: Comment not yet fully addressed. See comments for 5. d) above. Those
comments apply to both private and public easements. Address the comments.
Provide full addresses.
Rev. 2: Comment not yet fully addressed. Address the comments in #5 above
that reference public easements.
d) See the attached email from John Anderson, previously sent to you, in reference to
the process for the Stormwater Management deed and maintenance process.
Ensure this process is followed and completed.
Rev. 1: Comment not yet fully addressed. See the email from 12/21/18 in reference
to these two legal documents. Also, ensure that prior to signing the documents they
have been updated for the final revision date of the plat once it is approved.
Rev. 2: Comment not yet fully addressed. These documents have not yet been
recorded. Address the following:
i. Please be aware that the "Agreement to Maintain Stormwater Management
Facilities and other Techniaues":
a.Requires the County Executives Signature
Lis processed and recorded by County staff
c.It is my understanding from engineering that it must be recorded prior to
the "SWM Facility Maintenance & Access Easement" deed since that
deed references the deed book and page number of the "Maintenance
Agreement".
ii. For the "SWM Facility Maintenance & Access Easement" address the
following:
a. See 5. d) i. in reference to the revision date of the easement plat.
b. It also requires the County Executives signature. However, this
document will be recorded by the applicant with the other legal
documents.
iii. See 5. d) i. above about the time frame for Countv Executive sianatures.
[14-302 (B)(1)] General information. Add a revision date to the plat prior to the next
submission. No revision date was provided on the plat sent to the planning reviewer on
10/29.
Rev. 1: Comment not yet fully addressed. Address the following:
a) Add a new revision date for the next submission.
Rev. 2: Comment not vet fully addressed. Add a new revision date for the next
submission to all sheets.

10. [14-302 (113)(5)] Zoning classification. Address the following:
b) Either revise the setback information so that what is in the cover sheet and what is
provided in the title blocks of all the sheets match or remove the setback information
from the plat.
Rev. 1: Comment not yet fully addressed. Revise, on all sheets, the setback
information for the "side and rear". What is listed is the "minimum" and not the
"maximum". Revise it to specify "Side and Rear — Minimum:"
Rev. 2: Comment not yet fully addressed. Although the minimum and
maximum error specified above appears to be addressed there is another issue
with the setbacks that must be addressed. On all of the sheets, in the box with
the setback information, it states "(See Sheet 8 for RA setbacks)", however
there is no sheet 8 and the RA setbacks to not appear to be provided within the
plat. Revise the plat to ALSO include the RA setbacks list and not lust the HC.

Rev. 2: Comment not yet fully addressed. Although engineering does not have any
plat comments they do require completion and recordation of the documents they
have supplied either prior to or with the recordation of the plat. See comments
above.
