I received your recent resubmittal of SDP2018-83. While reviewing/distributing the proposal it became clear that you
submitted an exception application on a road plan application, along with an $892 review fee. Your request requires an
additional SE fee of $457 for the two SEs under Section 32.3.5. Also, the requested special exceptions are not submitted
on the correct applications, nor did you provide any justification for staff to review of the requests.
I offer the following required revisions to your SE requests so that we may process them. In the meantime I will transmit
the plans to the various reviewers for their review. Please revise your SE requests as follows:
1) [14-422] To omit the sidewalk and planting strip on the southern boundary of the new private street requires a
Planning Commission approval of a special exception to the private street standards as permitted in Section 14-
422(E), Section 14-422(F), and Section 14-203.1. Please submit the correct special exception application, fee
($892 — prev paid), along with appropriate/required justification.
2) [32.7.2.3, 32.3.5(b)(3)] To omit the sidewalk along the frontage of Camelot Drive requires a Board of Supervisors
approved special exception as provided for in Section 32.3.5(b)(3). Please submit the correct special exception
application, fee ($457), along with appropriate/required justification. Findings required for an exception. The
agent may approve a request for an exception from any requirement of section 32.7 upon finding that: (i) because
of an unusual situation, including but not limited to the unusual size, topography, shape of the site or the location
of the site; or (ii) when strict adherence to the requirements would result in substantial injustice or hardship by,
including but not limited to, resulting in the significant degradation of the site or to adjacent properties, causing a
detriment to the public health, safety or welfare, or by inhibiting the orderly development of the area or the
application of sound engineering practices.
3) [32.7.2.3, 32.3.5(b)(1)] To reduce the sidewalk with from 5' to 4' requires a Board of Supervisors approved
special exception as provided for in Section 32.3.5(b)(1). Please submit the correct special exception application,
fee (covered under the same fee mentioned in the above SE request), along with appropriate/required justification.
Request for a variation or exception. A developer requesting a variation or exception shall submit to the agent a
written request stating the reasons for the request and addressing the applicable findings in subsections (b)(2)
and (b)(3). When a variation is requested, the developer also shall describe the proposed substituted technique,
design or materials composing the substituted improvement. The request should be submitted before the site
review committee considers the initial site plan. The agent may request that the site review committee provide
information and a recommendation on any request for a variation or exception.
