HomeMy WebLinkAboutSUB201800160 Review Comments Easement Plat 2019-02-08�OV AL � � IRcir�ia County of Albemarle Department of Community Development Memorandum To: Rusty Coan (rusty(a-crossdevelopment.net) From: Paty Saternye- Senior Planner Division: Planning Services Date: November 8, 2018 Rev. 1: January 9, 2019 Rev. 2: January 31, 2019 Rev. 3: February 8, 2019 Subject: SUB-2018-160 Caliber Collision — Easement Plat The County of Albemarle Planning Division will grant or recommend approval of the Final Plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] [14-302 (A)(4) & (6)] Private Easements; Alleys and shared driveways. Address the following: d) Provide the required documentation to support and create all easements. All deeds that are required for the easements and maintenance must be submitted, reviewed by the County Attorney's office and recorded with this plat. Rev. 1: Comment not yet fully addressed. Address the following: i. ALL legal documents that include a reference to this plat must have the description of the plat updated with the final revision date prior to signatures and recordation. Rev. 2: Comment not yet fully addressed. The Stormwater Facility and Management Access easement, provided to you on 12/21/18 in an email from Frank Pohl, also must have the revision date for the proposed plat updated. Engineering will be providing you an updated version of this document so that the revision date will be correct at recordation. PLEASE NOTE that this is one of the documents that requires the County Executive's signature. So, once the revision date is updated a signed and notarized original must be provided with other deeds. Please keep in mind that since it will be signed by the County Executive, and must be approved by the County Attorney's office just prior to that signature, the signing process is not immediate. Rev. 3: Comment not fully addressed. An updated Stormwater Facility and Management deed of easement, leaving blank spaces for the revision date of the plat, was sent to you by engineering on 2/1/19. PLEASE NOTE that this is one of the documents that requires the County Executive's signature. So, once the revision date is updated a signed and notarized original must be provided with other deeds. Please keep in mind that since it will be signed by the County Executive, and must be approved by the County Attorneys office just prior to that signature, the si_pnin_g process is not immediate. iii. There are no comments on the "Deed of Stormwater Drainage Easement". Rev. 2: Comment not yet fully addressed. Submit a signed and notarized COPY of this document once the plat revision date is finalized. Rev. 3: Comment not fully addressed. Once the revision date is updated address the comment. [14-302 (A)(5) & 14-303 (L)] Public Easements; Public utility, drainage and sight distance easements. Address the following: c) Provide the required documentation to support and create all easements. All deeds that are required for the easements and maintenance must be submitted, reviewed by the County Attorney's office and recorded with this plat. Rev. 1: Comment not yet fully addressed. See comments for 5. d) above. Those comments apply to both private and public easements. Address the comments. Provide full addresses. Rev. 2: Comment not yet fully addressed. Address the comments in #5 above that reference public easements. Rev. 3: Comment not yet fully addressed. Address the comments in #5 above that reference public easements. d) See the attached email from John Anderson, previously sent to you, in reference to the process for the Stormwater Management deed and maintenance process. Ensure this process is followed and completed. Rev. 1: Comment not yet fully addressed. See the email from 12/21/18 in reference to these two legal documents. Also, ensure that prior to signing the documents they have been updated for the final revision date of the plat once it is approved. Rev. 2: Comment not yet fully addressed. These documents have not yet been recorded. Address the following: i. Please be aware that the "Agreement to Maintain Stormwater Management Facilities and other Techniques": a. Requires the County Executives Signature b. Is processed and recorded by County staff c. It is my understanding from engineering that it must be recorded prior to the "SWM Facility Maintenance & Access Easement" deed since that deed references the deed book and page number of the "Maintenance Agreement". Rev. 3: Comment not fully addressed. Address this comments. Submit the signed and notarized original document to the County for the County Executive's signature and recordation. This document is not processed by the planning reviewer. ii. For the "SWM Facility Maintenance & Access Easement" address the following: b. It also requires the County Executives signature. However, this document will be recorded by the applicant with the other legal documents. Rev. 3: Comment not fully addressed. This document must be recorded and recordation receipt sent to the planning & engineering reviewers. iii. See 5. d) i. above about the time frame for County Executive signatures. Rev. 3: Comment not fully addressed. Address the comment. 10. [14-302 (113)(5)] Zoning classification. Address the following: b) Either revise the setback information so that what is in the cover sheet and what is provided in the title blocks of all the sheets match or remove the setback information from the plat. Rev. 1: Comment not yet fully addressed. Revise, on all sheets, the setback information for the "side and rear". What is listed is the "minimum" and not the ,'maximum". Revise it to specify "Side and Rear — Minimum:" Rev. 2: Comment not yet fully addressed. Although the minimum and maximum error specified above appears to be addressed there is another issue with the setbacks that must be addressed. On all of the sheets, in the box with the setback information, it states "(See Sheet 8 for RA setbacks)", however there is no sheet 8 and the RA setbacks to not appear to be provided within the plat. Revise the plat to ALSO include the RA setbacks list and not just the HC. Rev. 3: Comment not fully addressed. Address the followinq: L Although the RA setbacks have been successfully added to the plat the reference to "(See Sheet 8 for RA setbacks)" was not removed or resided. Revise it to state "(See below for RA setbacks)" on all of the sheets. ii. Ensure a new revision date is added to each page of the plat. 16. [COMMENT] See the attach comment from other reviewers. Rev. 1: See the other reviewers comments. Rev. 2: Comment not yet fully addressed. Although engineering does not have any plat comments they do require completion and recordation of the documents they have supplied either prior to or with the recordation of the plat. See comments above. Rev. 3: Comment not fully addressed. Address the Rev. 2 comment.
