I am not aware of any comments on the as-builts but have emailed our engineer and asked him to confirm that he got them. However, we already went through an extensive submittal and review process of the as-builts with engineering; specifically with Greg Cooley, Warner Wilkerson, & Glenn. At the end of that process of reviewing as-builts, Greg Cooley informed me that there were no further comments from the County and Glenn subsequently informed me that the County was stepping out of the road as-built review process and would not be reviewing Fray's Grant any more. He directed me to work with VDOT for the remainder of the process, which I did. To receive comments on the as-builts from the County at this point seems very much out of order. Our understanding is that Virginia Code does not allow Albemarle to wait for VDOT to accept roads before reducing bonds. In addition, the 30-day statutory response time frame has expired, which I understand means that the bond reduction request is automatically approved. We appreciate the process and have worked diligently within the process to completely address all comments from the County and VDOT. We requested bond reductions several times in the last 2 years, all of which were denied by the County because VDOT had not accepted the road, which, per state law, is not a sufficient reason. We were patient and accepted the County's decision. Another complete application for bond release was made on January 6th of this year, after VDOT had completed its review and placed the item on the BOS agenda. We did not receive any response to this request. At this point we are asking the County to release our$1,177,120 bond. Please advise as to the County's decision at your earliest convenience. The BOS only adopted a resolution requesting VDoT add the road to the secondary system of state highways. Once the Clerk of the Board prepares the resolution, she will send the original to us and we will forward to VDoT. Once VDoT gets the original resolution, it usually takes 1 to 2 months for us to receive official notification that the road is in the secondary system. I am assuming that the only issue with release of the subdivision/road bond is getting the as-builts corrected and getting the notification from the VDoT stating the road is in their system. By copy of this e-mail, I am asking Ray and Glenn to confirm this is correct. Also by copy of this e-mail, I'll ask Glenn if will consider a reduction in the bond until these two items are taken care of. I haven't heard anything regarding our bond request since my last email almost 6 weeks ago. Will you please confirm that it has been released? The BOS accepted Fray's Ridge Crossing into the system yesterday.
