HomeMy WebLinkAboutSUB201800226 Review Comments Final Plat 2019-02-19County of Albemarle Department of Community Development 401 McIntire Road, Charlottesville, VA, 22902 Phone 434-296-5832 Fax 434-972-4126 Memorandum To: Chris Kean (chris.keanklincolnsurveying com) From: Cameron Langille, Senior Planner Division: Planning Date: February 19, 2019 Subject: SUB201800226 TMP 32-51, 32-52, 32-53, 32-54, 46-3 Boundary Line Adjustment Plat The County of Albemarle Planning Division will grant or recommend approval of the plat referenced above once the following comments have been addressed: [Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless otherwise specified.] [General Comment] Sheet 2 appears to state an incorrect TMP number for an adjacent parcel. a. The plat recorded in DB 5107 pages 617-620 identifies a 3.25 acre property to the southeast of existing TMP 32-54 as "TMP 32-58" which is consistent with the written property description recorded in DB 3323 pages 740-749. b. The plat recorded in DB 5107 pages 617-620 identifies a different 2.50 acre parcel further to the west as the true TMP 32-58A. This appears to be consistent with the location and size of TMP 32-58A that was described in the instrument recorded in DB 3323 pages 740-749. c. Please provide further information or documentation that the tax map parcel numbers are shown accurately, or revise the plat as necessary. 2. [14-302 (A)(1)] On Sheet P1, please provide a sheet index that explains what each sheets shows. Please revise the title bar so that lists each Tax Map Parcel (TMP) number individually. 3. [14-302 (A)(3)] Please state whether Berkmar Drive is a public or private right of way in the label on sheets 2 and 3. 4. [14-302 (A)(4)] Please show the location and dimensions of the Vepco easement that is called out on sheets 2 and 3. [14-302 (A)(4)] Please retitle the label for the "Approximate Stream Easement" on Sheet 2. The WPO Stream Buffer is not an easement; it should be labeled as "Albemarle County Water Protection Ordinance Stream Buffer." a. [14-302 (B)(10)] State the source used to obtain the stream buffer location in the note on Sheet 1. b. The instrument referenced in the label, DB 2678, page 581, does not appear to be a recorded easement plat or deed. Please explain why an instrument number is shown. Staff believes that this is an error, since the area is consistent with the WPO stream buffer location shown on TMP 32-51 in Albemarle County GIS. 6. [14-302 (A)(4)] Please show the location and dimensions of all existing ACSA easements on the properties on Sheets 2 and 3. 7. [14-302 (A)(9)] State the individual TMP numbers for each parcel in the building site note on Sheet 1. 8. [14-302 (A)(10)] Please make the following changes related to notes about development rights currently shown on Sheet 1: a. No plats for parcels TMP 46-3, 32-51, 32-52, or 32-53 have been reviewed and approved by the County since the adoption of the Zoning Ordinance in 1980. All surveys that have been recorded for these parcels since 1980 do not contain notes specifying how many development rights each lot has. The amount of development rights that the notes currently state belong to each parcel appear to be correct except for the following: i. The development rights note for TMP 32-52 is incorrect; the property appears to currently have two (2) development rights. The note states that the revised TMP 32-52 will have three (3) development rights. TMP 32-52 cannot have three development rights based on its revised acreage. Please revise the note. b. In all development right notes, please change the end of the last sentence so that the word "comprise" is not used. The notes should end with "The residue of Tax Map/Parcel [numbers] retains [number] development rights and when further divided it shall not consist of more than [number] acres." i. Revise the last sentence of the development rights note for TMP 46-3. The parcel currently measures 9.008 acres, and is obtaining 0.124 acres from TMP 32-52. Any further divisions of the revised TMP 46-3 shall not consist of more than 9.008 acres (which is the original acreage of TMP 46-3 before the boundary line adjustment). ii. The acreages stated for further divisions of TMP 32-52 and 32-53 do not need to be changed. These parcels are shrinking instead of expanding, so the figures states in the notes are correct. 9. [General comment] Remove the note related to subsequent divisions of residue parcels and entrances onto public streets currently shown on Sheet 1. 10. [14-302 (13)(1)] Please add a date of last revision to each drawing. 11. [14-302 (B)(5)] On Sheets 2 and 3, show the zoning district boundary lines for all primary zoning districts that apply to properties within the limits of this boundary line adjustment. Provide a label stating the source used to obtain the district boundaries. 12. [14-302 (B)(5)] In separate notes on sheet 1, please state the existing primary zoning district for each TMP that is part of this plat. Also state the primary zoning districts that will apply to each revised TMP based on the proposed boundary adjustments in the same note. Please be aware that the following TMPs currently have split zoning: a. TMP 32-53 is partially zoned R-15 Residential, and RA Rural Areas. State the acreage of each zoning district within the existing parcel boundaries in the note for TMP 32-53. It appears that the revised TMP 32-53 will be zoned entirely RA, and if true please confirm this in the zoning note on Sheet 1. b. It appears that with the addition of "Parcel B" and "Parcel C" to TMP 32-54, this property will be zoned both R-15 and RA. State the acreage of each district that will apply to the revised parcel boundary in the zoning note for TMP 32-54 on Sheet 1. 13. [14-302 (B)(5)] State all overlay zoning districts that apply to each revised TMP in the zoning notes for each TMP on Sheet 1 based on their revised parcel boundaries. Currently, the overlay districts that apply to each property are as follows: a. TMP 32-51 is within the AIA Airport Impact Overlay District, and portions of the property are within the Managed and Preserved Steep Slopes Overlay Districts. b. TMP 32-52 is within the AIA Airport Impact Overlay District, and portions of the property are within the Managed Steep Slopes Overlay District. c. TMP 32-53 is within the AIA Airport Impact Overlay District, and portions of the property are within the Managed Steep Slopes Overlay District. d. TMP 32-54 is within the AIA Airport Impact Overlay District. e. TMP 46-3 is within the AIA Airport Impact Overlay District, and portions of the property are within the Managed Steep Slopes Overlay District. 14. [14-302 (B)(5)] In the zoning notes for each TMP on Sheet 1, state all applicable proffers and special use permit conditions that apply to each revised TMP. State the application number for each zoning map amendment that established any applicable proffers, and state the special use permit application numbers that apply to each revised TMP. a. TMP 32-53 is subject to the proffers approved with ZMA199200014. The property is also subject to the special use permit conditions approved with SP199500025. b. TMP 32-54 is subject to the proffers approved with ZMA199200014. The property is also subject to the special use permit conditions approved with SP199500025. c. TMP 46-3 is subject to the proffers approved with ZMA199200014. 15. [14-302 (B)(10)] Revise the stream buffer note on Sheet 1 so that the first word is "The" instead of "Any." 16. [14-303 (A)] Remove the dual reference to TMP 32-52 in the statement of consent of division on Sheet 1. Re -title this from "Owners' Approval" to "Statement of Consent to Division." 17. [14-303 (D)] Please revise Sheet 2 so that the existing acreage labels shown on each property contain the word "existing." 18. [14-302 (B)(7)] On sheet 1, revise the note referencing the Powell Creek Watershed so that it states "TMPs 32-51, 32-52, 32-53, 32-54, and 46-3 do not lie within an Albemarle County or City of Charlottesville water supply watershed." 19. [14-303 (H)] On Sheets 2 and 3, provide a legend that identifies all permanent reference monuments used to identify the existing and proposed corners of the revised parcels. Provide a legend stating what each monument is (i.e. IF = Iron Found).
