We field verified that there were no buildings within 50' of the proposed property lines. The cabin on T.M. 102-40C is 77+ feet from the new line and is not required to be shown. The note on the plat recorded in D.B. 3588-154 & 155 should not have stated that 40B may not be further divided. 40B has one development right and may be further divided. It is possible to divide off 21 acre lots from the 83+ acres. Once you have had a chance to review this, please let us know if the plat is ready for owners notarized signatures. Regarding the development rights notes, I still think Notes D and E are not worded quite correctly and I am seeking Francis MacCall's direction on this before I get back to you. He is our authority on development rights. Because the previously approved subdivision had the incorrect development right wording, I want to make sure this is worded exactly as it should be. It's just a matter of semantics I believe. I was not aware that Francis was going to be out today and Monday. I have set up an appointment with him for this coming Tuesday at 11 so I can get his take. I will email you immediately following the meeting so we can wrap this up quickly. Sect. 14-312 Location of existing buildings: It is unclear if the dwelling on TMP 102-40C meets the requirement for showing a building within 50' of a proposed property line.
