Tax Map ##02200-00-00-003D0 (a portion thereof) (2.00 acres) THIS DEED OF GIFT,which is exempt from recordation taxes pursuant to Section 58.1- 811(D) of the Code of Virginia, as amended,made this 18th day of February, 2019,by and between FINLEY LEE RAGLAND,JAMES ROBERT RAGLAND,BETTY JANE RAGLAND,LOUIS A.RAGLAND and BERNARD L.RAGLAND,hereinafter referred to as the Grantors,and BETTY JANE RAGLAND,hereinafter referred to as the Grantee,whose address is 3565 Burnley Station Road, Barboursville,VA 22923; WITNESSETH : THAT FOR AND IN CONSIDERATION of the LOVE AND AFFECTION between the parties,the receipt of which is hereby acknowledged, and other good and valuable consideration, the Grantors do hereby GIVE, GRANT and CONVEY with GENERAL WARRANTY and ENGLISH COVENANTS OF TITLE unto the Grantee, all that certain lot or parcel of land, situated on the south side of State Route 641 in Albemarle County, containing 2.00 acres, more or less,designated as Parcel 3D on a plat by Residential Surveying Services,dated May 23, 2018, and recorded in the Clerk's Office of the Circuit Court of Albemarle County, Virginia, as an attachment to this deed; and BEING a portion of the same property(Lot No. 4; originally 25 acres)that was conveyed to Finley Ragland,by deed of Lucy Ragland, widow, and others,dated September 19, 1960,and recorded in the aforesaid Clerk's Office in Deed Book 363,page 14. • By a deed dated October 12, 1973,Lucy Ragland,widow, and Finley Ragland and Dorothy Ragland, husband and wife, conveyed 3 acres of the original 25 acres to Finley Lee Ragland (Finley &Dorothy's son), and this deed was recorded in the aforesaid Clerks Office in Deed Book 539,page 598. The said Finley Ragland died intestate on May 30, 1993,and as evidenced by a Real Estate Affidavit filed in the aforesaid Clerks Office in Will Book 157,page 730,the subject property passed to his wife and only heir, Dorothy Mae Ragland. The said Dlorothy Mae Ragland died intestate on September 23,2004,and as evidenced by a Real Estate Affidavit filed in the aforesaid Clerks Office in Will Book 157,page 722,the subject property passed to her five children and only heirs; namely, Finley Lee Ragland,James Robert Ragland,Betty Jane Ragland,Louis A. Ragland and Bernard L.Ragland. By a deed dated February 2, 2017,the aforementioned five (5)heirs,the Grantors herein, conveyed 10.010 acres,more or less,of the original 25-acre tract(T.M. 22-3; less the 3 acres conveyed to Finley Lee Ragland as noted above) to Leslie Ann Ragland, said deed with attached plat being recorded in the aforesaid Clerks Office in Deed Book 4875,page 498. The aforementioned five (5)heirs,the Grantors herein, conveyed a parcel of land, containing 4.39 acres,more or less,to Christina Elizabeth Ragland by a deed(with attached plat) dated July 19,2018, and recorded in the aforesaid Clerks Office in Deed Book 5092,page 543. The parcel known as Tax Map 22, Parcel 3D was reduced by the acreage in Lot B, Lot C and Lot D as shown on the attached plat, so that 8.62 acres,more or less,was the residue of Tax Map 22, Parcel 3D. The parcel conveyed herein is a portion of the residue of 8.62 acres. The plat attached hereto shows the new creation of a 30-foot wide private street which runs along the boundary line between the parcel created herein and Finley Lee Raglands(new) r a parcel until it reaches the newly created parcel known as Lot E (6.62 acres) on the attached plat. A private street maintenance agreement between Betty Jane Ragland and Derek Ragland and his wife,Rachel Ragland, the new owners of Lot E (as established by a deed recorded immediately hereafter), shall be recorded in the aforesaid Clerk's Office immediately after the said deed to Derek and Rachel Ragland. The grantors herein also create an easement for the benefit of the new Lot E(containing 6.62 acres)to use the well that is located on the new Parcel 3D (near Burnley Station Road) as shown on the plat attached hereto. This easement shall run with the land. This conveyance is subject to the easements, conditions,restrictions,reservations and other matters contained in duly recorded deeds,plats and other instruments constituting constructive notice in the chain of title to the property herein conveyed which have not expired by a limitation of time contained therein or have not otherwise become ineffective.
