The County of Albemarle Planning Division will recommend approval of the plat referenced above once the
following comments have been satisfactorily addressed (The following comments are those that have been
identified at this time. Additional comments or conditions may be added or eliminated based on further review.):
[Each comment is preceded by the applicable reference, which is to the Subdivision/Zoning Ordinances unless
otherwise specified.]
NOTE: This final subdivision plat requires a "preliminary plat exhibit" because no preliminary plat was nreviousl
approved. A second submission was not provided for the "preliminary plat exhibit" despite comments having been
specified for that exhibit because information was not provided, or incorrectly provided, in the first submission of
the exhibit. However, a final site plan is also under review for this same phase and layout. Therefore, for the
purpose of these comments the submission of SDP2018-59 Belvedere Phase IVA-1 Final Site Plan (revision date 12
28118) has been used in place of the 2"d submission of the preliminary plat exhibit.
[14-302(A)14, 14-303(C)] 14-303(G), 14-317] Dedication of open space; Boundary lines; Instrument
evidencing maintenance of certain improvements. It has been noted that the open space and alleys will be
dedicated to, and maintained by, the Belvedere HOA. Address the following:
d) Submit an instrument assuring the perpetual maintenance of the alleys, the stormwater management
facility, the open space areas, and any other improvements that are to be maintained by the HOA in
perpetuity. County Attorney approval is required prior to final plat approval.
Rev. 1: Comment not vet fully addressed. A supplemental declaration has been submitted that
covers these required improvements and area. Please address the following:
i. Revise the Phase IVA-1 supplemental declaration to have the correct acreage for
the open space that is specified in section 5.a. of the document. The size for the
proposed open space is shown as 2.184 AC. on sheets V5 & V6 and not 1.934 Ac.
ii. The private storm drainage easements are included in the Phase IVA-1
supplemental agreement. Therefore, no additional legal document needs to be
submitted for the "private" storm drainage easements.
iii. The two "public" storm drainage easements shown on the proposed plat will be
recorded with the Phase IIB subdivision plat, dedicated to public use with the
Phase 11113 drainage easement legal document (template provided to applicant with
Phase 11113 comments on 2/27/19), and must be shown as "existing" on the next
submission of this Phase IVA-1 plat since it is the reviewers understanding that
Phase 1113 plat and documents will be recorded prior to this plat. Therefore, no
document needs to be provided for Phase IVA-1 in reference to the "public"
drainage easements.
[Comment] Revise the proposed streets, street labels and street dimensions to show the width proposed.
Address the following:
a) The west portion of Fowler Street does appear to match its label.
Rev. 1: Comment not yet fully addressed. Revise the street width dimension for Fowler Street, on the
west side of Belvedere Blvd, to be correct on sheets V2 & V3.
8. [14-311] Infrastructure improvement plans. All infrastructure required to construct phase IVA shall be
reviewed, approved, and built or bonded before the final plat can be approved. This includes all offsite
improvements required to serve the development, including road plans, WPO plan, water and sewer
connections which are part of phase IIB.
Rev. 1: Comment still valid.
10. [14-302(A)4&5] Private & public easements. If any portion of the Rivanna Trail is to remain then show the
trail head and trail location. On the subdivision plat depict its current location and where the trail head will be
relocated. Is there an easement for the existing trail? Show any existing or proposed easement for the trail
and provide deed book and page information. Provide this documentation for review/verification prior to
approval of the final plat. Please note that note 11 on the Final Subdivision Plat specifies a trail easement.
However, one does not appear to be shown on the Final Subdivision Plat or the Preliminary Subdivision Plat
Exhibit.
Rev. 1: Comment not yet addressed. Either remove the reference to the "Trail Easement" in note 11
on the cover sheet or show the proposed easement on the plat and provide proposed the document
for the easement to the reviewer.
11. [14-302(A)2] Vicinity map. Revise the vicinity map to depict the two phases of the subdivision and emphasis
the portion of the subdivision which a final plat has been requested. Also, label and depict phase IIB as it is
required to be approved prior to the approval of phase IVA. Also, provide existing property lines for phase
IVA and the future phase IVB.
Rev. 1: Comment not yet addressed. Address the comment. The vicinity map shown on the cover
sheet appears to be for both Phase IIB and Phase IVA-1, and not differentiation for them (hatch or
labels) is provided. Also, please note, that the edge of the Phase IVA-1 is no longer shown properly
since it no longer includes all of the area shown in the vicinity map hatched area.
21. [14-302(B)6] Tax map and parcel number. Once SUB201800098 Belvedere Phase IIB Final Subdivision
Plat is approved revise the existing conditions sheet to do the following:
b) Include the Deed Book and Page Number reference for the recorded Phase IIB plat.
Rev. 1: Comment not yet fully addressed. Ensure all lots that will be created with the recordation of
SUB201800098 Belvedere Phase IIB Final Subdivision Plat show blanks for the deed book and page
number of that plat on the existing conditions sheet (V2). None of the residue parcels from the
Phase IIB plat have the deed book and page number as part of their label.
22. [14-302(A)3] Existing or platted streets. Address the following:
a) Label all streets and alleys and include in those labels whether it is existing or proposed and whether it
is public or private. These labels should be provided on both the Preliminary Subdivision Exhibit and the
final subdivision plat.
Rev. 1: Comment not yet fully addressed. "Public" and "private" street labeling is not provided
on all of the sheets. Address the following:
i. Add "Public" to the labels for Belvedere Boulevard and Fowler Street on sheets V4 and V5.
ii. Add "Public" to the labels for Fowler Street on sheets V7 and V8.
iii. Create a label for Winn Alley on sheet V8 and ensure it includes all required information
including "private" and a blank for the deed book and page number for the phase IIB plat.
c) Provide the widths of all streets in phase IIB in addition to the streets in phase IVA.
Rev. 1: Comment not yet fully addressed. Sheet V3 still shows the west side of Fowler Street as
being a smaller width than required. Revise its label on this sheet to be correct, with a width of
61'.
23. [14-302(A)4&5] Private & public easements. Address the following:
a) Provide on both the Preliminary Subdivision Plat Exhibit and the Final Subdivision Plat the location and
dimension of all existing and proposed private and public easements.
Rev. 1: Comment not yet fully addressed. Address the following:
i. Show the "existing" ACSA and storm drainage easements on sheets V4 through V8.
ii. Ensure easements created with the phase IIB plat are not shown as "proposed" on this
plat. There are two "public" storm drainage easements, at the intersections of roads,
shown as proposed on this plat but should be represented as existing. Ensure when
revising them to be shown as existing that they also include blanks for the deed book and
page number of the Phase IIB plat.
iii. If it is not wished to show the existing ACSA and storm drainage easements on sheets V4
through V6, then add a sheet like sheets V7 & V8 that shows the proposed lots 229 through
235 and all existing and proposed easement that impact them.
c) Existing easements should be labeled with the appropriate DB and PG reference. Proposed easements
should be labeled with the intended holder.
Rev. 1: Comment not yet fully addressed. Add DB and PG reference for all "existing" easements
shown on all current and added sheets. If they will be "existing" once the Phase IIB plat is
recorded the DB and PG reference should have blanks that can be filled in later.
27. [14-302(A)4&5] Drainage Easements. On the plat depict, dimension, and label all drainage easements as
either public or private.
Rev. 1: Comment not yet fully addressed. Address the following:
a. Revise the storm drainaae easements to match those shown on the WPO that is beina amended
and the most recent submission of the Phase IVA-1 final site plan.
b. Ensure that all references to the drainage easements that will be created with the Phase IIB plat
are updated to address comments provided for that plat, such as portions of private storm
drainage easements that are within the private alleyways, do not include any public storm
drainage, and are incorrectly labeled on both the Phase IIB and this plat as "public".
c. On sheet V2 there are two "public" storm drainage easements at the intersections of the roads
that are not shown even though they are shown on later sheets. Show those easements on
those sheets.
d. Since there will not be any "public" proposed drainage easements, or stormwater maintenance
easement, on this plat once it has been revised remove Note #14 from the cover sheet V1.
28. [14-303(B)] Acreage of lots. Provide clear information on all portions of the "existing" lots on the Preliminary
Subdivision Plat Exhibit. Ensure the values shown match those created by previously recorded, or to be
recorded subdivision plat. The parcel information on the Preliminary Subdivision Plat (7.53) does not
appear to match those of the ones on the Final Subdivision Plat (6.523). Ensure the lot information on these
two plats are complete and correct.
Rev. 1: Comment not vet fully addressed. Revise the existina conditions sheet to show the deed
book and page number blanks for all of the lots created with the Phase IIB plat. The acreages of the
"existing" parcels shown here match the lots created with Phase IIB plat and are therefore correct.
However, please note that the acreages shown in the Final Site Plan are not the same as shown here
wand will need to be revised in the Final Site Plan.
29. [14-303(L)] Public utility, drainage and sight distance easements. Address the following:
a) Ensure all public utility, drainage and sight distance easements that are existing or proposed are shown
on both the Preliminary Subdivision Plat Exhibit and the Final Subdivision Plat.
Rev. 1: Comment not yet fully addressed. See comments above in reference to labeling and
representation of the existing and proposed easements.
31. [14-303(S)] Control points. Provide at least four (4) control points, evenly distributed across the property
and located at survey property corners and shown on each sheet depicting the property.
Rev. 1: Comment addressed. Address the comment or specify in a comment response letter where
the required control points are already provided.
32. [14-302(A)(7)] Existing and departing lot lines. The existing lot lines do not match the current GIS. Provide
the deed book and page number, or a label and a space for the deed book and information, for the plat that
created or will create those lot lines prior to the recordation of this subdivision plat.
Rev. 1: Comment not yet fully addressed. Include in the existing condition sheets a deed book and
paae number blank in the label for each of the parcels created with Phase 1113 subdivision slat.
35. [14-317] Instrument evidencing maintenance of certain improvements. Provide the legal documents that will
be required for the ownership and maintenance of the private alleys and open space. These documents will
be reviewed by the County Attorney's office. These legal documents must be approved by the County,
signed and notarized, and a copy provided to the County prior to final plat approval. These documents must
be recorded with the final plat.
Rev. 1: Comment not yet fully addressed. See comment #3 above in reference to maintenance of the
open spaces. All alleys will be created with Phase 1113 plat, and the legal documents in reference to
the maintenance of the alleys is being reviewed with that plat.
39. [Comment] This final plat will not be approved until the final road plan is approved and the alleys are built or
bonded. This final plat will be required to show the public road and private alley right of way widths
specified in that road plan, once it is approved.

41. Rev. 1: [NEW COMMENTI Revise sheet V7 to show the correct proposed stormwater drainage and
management easements. These easements have been changes on the Phase IVA-1 Site Plan, and
the Phase 1113 Road Plan, but not yet updated on this plat.
42. Rev. 1: [NEW COMMENTI Revise the note on sheets V2 through V5 for the recordation information
for public streets and private alleys recorded with Phase 11113 so that it says, "private alleys" and not
"private streets". There are no private streets proposed in Phase 11113 subdivision plat.
43. Rev. 1: [NEW COMMENTI Revise not #11 on sheet V1 to no longer reference "private streets".
Instead it should specify "private alleys".
44. Rev. 1: [NEW COMMENTI Revise the sheet title, in the title block and border, for sheet V7 to be for

4. Provide /show ACSA water and sewer easements necessary for basic utilities required to support subdivision; see
Notes 12 and 13, sheet V1.
5. V2: Fowler Street shows a 61' ROW beyond station 14+95 according to the street typical sections on the FSP (57'

The Department of Transportation, Charlottesville Residency Transportation and Land Use
Section, has reviewed the above referenced plan as submitted by Roudabush, Gale, &
Associates, revised 14 January 2019, finds it to be generally acceptable. If further information is
desired, please contact Justin Deel at 434-422-9894.
A VDOT Land Use Permit will be required prior to any work within the right-of-way. The
owner/developer must contact the Charlottesville Residency Transportation and Land Use
Section at (434) 422-9399 for information pertaining to this process.
