All portions of Avemore are subject to ZMA 2000-010 which rezoned the property to R 15, proffered. Because this development was rezoned as one site with a proffered Conceptual Development Plan, we can permit the density to be "spread" over the project, and, property lines added without regard to the density of any one internal parcel, provided that the overall density is maintained. This does require that the project be developed in general accord with the Conceptual Plan including all amenities and open space. In addition, all phases and parcels within the project must share access easements for both vehicular and pedestrian travel, recreational amenities and stormwater management facilities. The recreation for this development is based on the whole project, not divided between phases orparcels. Therefore, the Countywill require legal documents to be recorded demonstrating that the facilities are shared prior to signing any site plans for future phases. If future proposals for site plans include separate recreational facilities, the County may consider those independently and if sufficient, may not require shared facilities. This would accommodate the amenity master plan that you sent me on Friday. The Land Use Summary on the Conceptual Development Plan shows that 406 dwelling units were proposed to be developed. To date, you have approved site plans and building permits for 280 apartments in Phase I. Of the remaining 126 units, you would like to commit 92 units to Phase II on new parcel Cas shown on SDP2004-117. This leaves a total of only 34 dwelling units that will be able to be developed on proposed Parcel B. This division of residential density and dwelling units is permitted by the county provided the requirements of paragraph one are met.
