This letter is to make you aware of a Zoning Text Amendment, ZTA 2018-02, that is scheduled to be
heard by the Board of Supervisors on February 6, 2019. This amendment may impact property you own.
You have been identified as the owner of property zoned CO, Commercial Office, C-1, Commercial or HC,
Highway Commercial and that property is designated to have no public water service, limited public
water service or public water only to existing structures.
The proposed amendment impacts properties zoned CO, C-1, and HC. As the ordinance is currently
proposed, Convenience Stores, eating establishments, fast food restaurants, and automobile service
stations would be permitted by -right if they were served by public water or an approved central water
system or within a building existing on February 6, 2019. Convenience Stores, eating establishments,
fast food restaurants, and automobile service stations not served by public water or an approved central
water system would be permitted only by special use permit.
The proposed amendment would also make uses permitted by -right in the Rural Areas (RA) district
available to properties zoned CO, C-1, or HC when not served by public water or an approved central
water system.
The proposed ordinance would also clarify that convenience stores are a permitted use in the C-1
district by listing them as a specific use. Currently convenience stores are not listed in the C-1 district.
However, they are permitted because of a determination by the zoning administrator that other uses
listed in the district are of similar character. This amendment would reduce confusion and codify a long
standing practice of the County.
The Planning Commission has recommended that the proposed ordinance permit all by right uses in the
CO, C-1, and HC districts within a building existing on February 6, 2019, even if the use is not served by
public water or an approved central water system. Currently, uses not on public water or an approved
central water system and within existing structures are subject to a special use permit if they consume
more than 400 gallons per acre per day.
The Board of Supervisors has scheduled a public hearing for this zoning text amendment on February 6,
